Ethics hearing against Building Department
#61
Finally! Somebody acknowledged that Rob Tucker was not treated fairly or according to the regulations, but will there be any consequences and will such behavior stop? Like others, I'm cynical, but this is a start.

Were any punitive actions taken

In a "fair and just" scenario, the building department would be required to put up the next few modular farm buildings. Maybe they would even learn something.

1. No compensation, no apologies. They did lose me some business by confusing customers about what they can or can't do.

I talked to an architect about it yesterday who told me they denied his subdivision a permit exemption for a small shelter over their mail box cluster on AG land. Required engineering too which cost them $800. I told him he should demand a refund of the permit fees at least.

2. They never admit guilt or mistake. This all took place with the county attorney. I will say this though...one of those I filed the ethics complain against is no longer there. He's gone.

I'm glad that you were successful but, ever the cynic, I have a couple of questions:

1. Did you or will you receive any compensation for the 2 years or so that they delayed your project?

2. Were any punitive actions taken against the responsible parties?

If the answer is no to both of these questions, then I would say that they were successful in their endeavors to jam you up, and I would expect this behavior to continue.

Bonus question: Did they even offer an apology?

Assume the best and ask questions.

Gone as in really gone, or gone as in moved to another, perhaps less visible, position? I say that because the usual practice for dealing with bad county and state employees is to just move them around and not fire them. I know of one situation in the Department of Education where the "solution" for a particularly incompetent school principal was a promotion to the district administrative office.

Gone as in not in the building department. Other than that I can't say.

Well, that's something. At least this person won't continue to treat others the way you were in the building department.

I'm sure Parks&Rec has to staff up for all the new grass that needs mowing...

Be on the lookout for the dept. asking for a " correction " in the code. A few word change is easy to slip by, but can make all the difference in application

You had to have a commercial farm operation.

This requirement is also very interesting: it's from the proposed "tiny houses" bill -- which Ige intends to veto, because "County code already allows farm housing".

lookout for the dept. asking for a " correction " in the code

Codes only penalize the law-abiding citizens who attempt to follow them.
