BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
1 SECTION 1. Chapter 481X, Hawaii Revised Statutes, is
2 amended by adding a new part to be appropriately designated and
3 to read as follows:
4 “PI~RT . INTERNET SERVICE PROVIDERS
5 §481X— Definitions. As used in this part:
6 “Internet service provider” means a company that provides
7 access to the Internet.
8 “Internet protocol address” means is a numerical label
9 assigned to each device participating in a computer network that
10 uses the Internet Protocol for communication and provides host
11 or network interface identification and location addressing.
12 §481X- RecorclJceeping requirementà for internet service
13 providers. Any internet service provider that provides internet
14 service to a consumer in the State shall retain consumer records
15 for no less than two years. The required data for the consumer
16 records shall include each subscriber’s information and internet
17 destination history information. Destination information shall
18 include any of the following:

(3) Host name.”
SECTION 2. Chapter 481X, Hawaii Revised Statutes, is
5 amended by designating sections 4BlX—l to 4SlX—12 as part I,
6 entitled “General Provisions”.
7 SECTION 3. This Act shall take effect upon its approval.

Hey all:
The Economic Revitalization and Business Committee deferred HB2288.
At the moment it appears no further hearings are scheduled.
2 ERB members are from the Big Island.
They are: Clift Tsuji D-3 and Cindy Evans D-7.
It appears they were not among the Bill's introducers.
But let's keep an eye on it just in case.

This bill doesn't provide for internet censorship ... in what way?

They need a way to find out who committed crimes and torts using an anonymous handle (to an extent, not exactly a foolproof system with people leaving their wifi unlocked).

There was a case I read of in 2010 that involved trade secrets being published on the web. The company filed a civil case against John Doe and got a subpoena to find out who was doing it. They then worked with the person to stop the behavior. Without records by ISP they would have had no recourse.

While a corporation might not be the most sympathetic example, it is one I had at hand. But to use a hypothetical, suppose someone gets a hold of all your sensitive info, all your identifying info, and publishes it. Or suppose someone gets a bunch of unfortunate photos of you in the nude or engaging in private acts, and publishes them.

Would you not want to pursue that and find out who and why? But what if the police say, sorry, the ISP involved has no record of which subscriber address was responsible? Investigation closed, so sorry ...

The truth is that there isn't nearly enough manpower out there to bother with anyone who isn't doing something seriously wrong, and not even then.

Rather than edit my earlier post, just want to say that I missed that little term saying providers would keep records of Internet destinations. I didn't realize it meant they would keep records of each person's entire browsing history.

Yeah, I think that is outrageous. Fortunately this is no longer going forward.

Any and all regulation of the internet will be used for censorship no matter what the wording is. That is the goal, the only reason for them to pass it, to control it. Its one of the few places they don't have control and they cant stand it. Your bill will be used for the same purpose if it is passed. Have fun in the Communist future, soon our internet will be just like China. But no one will be getting harassed or looking at child porn so it will all be O-****ing-K!

afw, there is already a cyberharassment statute in Hawai'i. It was enacted in 2009. The current proposed bill on harassment is NOT a new law. It is just clarifying the language, not enacting any new powers over the internet.

Look on any list of states with cyberharassment statutes and you will see that Hawai'i was on the list early on.

The impersonation bill (which I had nothing to do with) does create a new felony charge.
