Ford Sues County Over Leithead Todd Appointment

Councilwoman Brenda Ford is asking a judge to rule that Department of Environmental Management Director Bobby Jean Leithead Todd is not qualified to hold that position because she doesn’t have an engineering degree.

In a petition filed Thursday in 3rd Circuit Court in Kona, Ford’s attorney, Michael Matsukawa, cites the county charter’s requirement that the DEM director have “an engineering degree or a degree in a related field.”

“Since the respondent Bobby Jean Leithead Todd does not have an engineering degree or a degree in an engineering-related field, the respondent does not have the qualification required to hold the office of director of the Department of Environmental Management for the county of Hawaii,” the petition states.

Ford referred questions to Matsukawa on Monday. Matsukawa said the petition speaks for itself. The petitioners are seeking legal fees from the county, in addition to a ruling that Leithead Todd be “restrained from performing the duties of that office,” according to the petition.


Ford can't seem to get rid of her disdain for some County employees/appointees. BJLT has served this County well given the challenges of each department she was called upon to direct. Ford is costing us taxpayers more legal fees for little gain. Change the Charter language, if necessary, but suing the County is totally counterproductive. My Papa used to always say, "You get more bees with honey than vinegar".

Or, is she still pissed she's not Chair of the Council? Geeze. (Watch the video of her being sworn in after Yoshimoto is chosen as Chair.)

BJLT lacks "experience" if you follow a "strict" interpretation of the "qualifications".

That said, it hardly matters who is "elected" or "appointed" to any "leadership" position; the local "big landowners" have more than enough monetary and political capital to ensure that they get their way -- upgrading the "leadership" to be more "pro-growth" would only result in "growth" that benefits the "big landowners". (Basically just like today, but the projects would move a little faster.)
