Aloha UsGuys. I'm really sorry you had to go through such a threatening situation and glad you're ok. I really admire the way you handled it. It reminds me of times my neighbor is off his meds, on self prescribed ones, or both. I'm wondering, do you have dogs? Maybe I'm kidding myself, but I feel safer with more eyes, ears and noses keeping track of who's around. I can honestly say that in 30 plus years, no one has gotten near my property without the dogs letting me know. The few unwanted guests who did take the chance have left in a hurry. The only drawback is that many of my friends don't think as highly of dogs as I do, and they leave pretty quick too!

KaloliJim, if this guy is advancing towards me with a machete raised and ready to swing i will roll the dice every time! I'd rather come up craps than pass and have myself or a family member injured or killed. If I had my weapon on my person, that's how it would have probably went down. However I am a law obiding citizen and being so, like I stated before, I barricaded myself and family behind my front door, retrieved my weapon from my safe, proceeded to load my weapon and hoped I didn't have to use it. I'd rather be judged by 12 than carried by 6.

That being said,
The indictment was delayed today because his public defender had a conflict of interest, so Mr. Das waived his right to s speedy trial and all is scheduled to continue this Friday at 9:00am. My TRO was granted today and he was served while in custody. The two children involved were present at the court house with parents in tow. The dad is a deputy sherrif btw. I actually feel Sorry for the guy. I hope this is his rock bottom and he turns his life around.

I helped organize multiple witnesses who were all terrorized by hopefully, a different machete bearing member of the community. I encourage you to ask neighbors if they had problems too.
This particular man received jail time and is perhaps now rehabilitated.
I know this isn't funny. However, I will share what the defense attorney asked.
"It seems highly improbable a man would have a machete in his car, are you certain it was a machete?"
We all sitting in the gallery exchanged looks since almost everyone carried on.

read the link you provided, UsGuys (ยง703-304 Use of force in self-protection). seems KaloliJim's summary of how the law basically works is indeed an accurate one. sounds very advisable to reserve the use of deadly force strictly to completely bonafide situations where no other reasonably safe option is available to protect persons from the immediate threat of serious felonies.
so glad to hear that incident ended safely for you and your family without the trauma undoubtedly involved with the violent loss of human life at close proximity, especially for children.
