This crime I saw in a video
#21
I have seen a couple of different videos about this. In one at the very first it shows the guy without the guns grabbing an pushing the one with the gun and he hadn't pull it yet.. It show the guy with the gun backing away from other guy still not pulling the gun then other guys advance toward him and then the guns is drawn. From what seen on this video it could call self defense in some states. After he pulled the gun he total over acted' There is more to this story then is being said.

No matter what happened beforehand, he had no reason to pull out the gun. He could've walked away.

Where did you find the video showing more than the one that is all over the web?

The first video posted in the Facebook group Big Island Thieves showed the young guy yelling at and rushing the older man who was backing up. the older man backed up two steps then raised his left arm to stop and push the younger man back before he raised his gun with his right. It was hard to determine if the gun was in his pocket or if he was just holding it near his pocket. The video was edited shortly thereafter to remove the younger guy rushing up and started with the older man wielding the gun.

"It's hard to believe you're still defending this lunatic..."

When the heat of the incident is over months later and we move to court proceedings, which are supposed to be more dispassionate, we will then need ask the key question: What penalty should be imposed?

We have assertions that the looter should get 30 years in jail and this guy should get Life. Since he is 61 years old I presume people mean Life without Parole.

5 years in prison for each of these guys is probably appropriate. (and reality is that 5 year prison terms sometimes have parole in 2 to 2 1/2 years).

The shooter's actions were terrible, but an unavoidable point is that no one was injured.

More details came out in court yesterday... Hubbard is a convicted drug dealer with a second conviction for illegal possession of a gun; also: he allegedly pointed his gun at one of the two young women present, demanded her cellphone, and chucked it into the jungle.

You keep referring to a "looter". Who are you talking about?

This guy arrested about May 11.

Both crimes are very bad. Both men deserve serious prison time. I don't think a 30-year-prison term (for burglary) or Life in Prison (for the shooting) is what the courts will eventually dispense. But if people want to call for that, OK.

Nonetheless they were warning shots and cannot be presumed to be shots intended to injure.

And it is clear his intent was getting the person to leave. He should get less time in prison than the looter (but be forbidden to own a gun).

I'd call it attempted murder.

Btw: looks like his house was eaten by the lava today
