What would you do???

What would you do if an x-friend was so pissed at you he made a false police report?

This has happened to me and is hard for me to fathom. Let me explain and try to keep it short.

A now e-friend was on my lanai with some others drinking some beers and he got out of hand by threatening my son with bodily injury. [my son was not there at the time] I told him to leave and not come back and went into my house. He did not, and continued to threaten about what he was going to do. I demanded him to leave and he came in thru my closed screen door and came at me. Long story short, so I clubbed him in the melon and sent him to the emergency room for a bunch of staples. He is 35 years old and I’m 66 not much of a match and I’m way too old for a ass whippen so I just wacked him instead of putting a cap in his knee.

Now my son got in some trouble for growing some pot [he is guilty and will pay for it] He was also falsely accused of a burglary by a neighbor. He was fishing on a commercial fishing boat at the time. The neighbor and this person cooked up the burglary and the police know it. They wanted to talk to this person and asked my son to get his address. He drove by with his girl friend and his two year old baby to get his street and house number for the police. This person then made a false police report saying that my son brandished a hand gun when driving by. My son was arrested then released pending investigation. They know that it is BS but have to follow thru with the report. What would you do????

Get an attorney for him. Make very sure he keeps his nose clean until all is resolved. Make sure he stays away from his antagonist and has no contact with him of any kind. That includes staying away from his residence and place of employment. Make sure his girlfriend files a sworn written statement. Get written sworn statements from those on the boat who are providing his alibi for the burglary. If he is innocent and you have those reliable witness's for his alibis, ask for speedy trial.

I can provide no legal advice as I'm not an attorney. Get one. These are just the musings of a layman.

Oink gave good advice. As far as, "What would I do?" Let the truth prevail. I am pretty sure I would not have whacked a drunk friend... but then he did not come after me! Maybe I would have locked the doors when I went in the house. Hang in there Lack, things will work out.

Which came first, Tom? The second incident with the drive-by? Trying to follow.

Isn't filing a false report a crime?
I would get an attorney. Yeah, it's expensive, so even though it's generally the best course I think for a lot of us we would try our best to avoid it -- but in this case not sure that's an option.

If the police really think the report is BS, I would not be at all surprised if their follow-up is not much. But be prepared anyway.

No idea how to deal with the fight thing. He could probably come after you for battery as he's the one with the damage ... putting the burden on you to prove your story, so did the others who were there witness that he came after you? I hope so.
