trying to sell unfinalized owner/builder home

So i listed my home for sale 430 something days ago. No buyers.....Finally, 430 something days later, I get a prospective buyer. Home is now in escrow. BUT NOW, my realtor tells me that because my addition is not finalized, I have run into a brick wall. Basically, because I took the permit out as an owner/builder, once the addition is finalized, I am unable to sell the home for 12 months. The good news is that if I find a general contractor willing to sign off on the addition, then I can continue with the sale. Well, I have been searching weeks on end to find a contractor willing to do it. Anyone know of someone who can help me? Needs to be a lisenced contractor. I will pay to have this done. Sad House needs to go. I am losing money each month on it. Sad HELP please!!!!

John Padilla. I don't know his number, but he's in the book. His brother's name is Rome, Romeo.

He is/was a forman for G.W., although I don't think it's appropriate to call them directly to contact him.

He's licensed and knows absolutely everything about construction, construction in Hawaii and has done some inspection/sign-offs for us and friends and neighbors. He's north of Highway 11 maybe just shy of Mt. View, closer to Kurtistown.

When we were less educated on Puna real estate we put an offer in on a home that had an unpermitted addition. We were told this (pasted from an email)

"All unpermitted improvements MUST be built in a workmanlike manner, conform to the dwelling, common for the area and pose no health or safety issues. The appraiser has to stipulate this in the report."

If the appraiser does not stipulate, the lender will not loan. Even if the appraiser does stipulate, some lenders still will not loan. If the general contractor is already being brought into the discussion, it probably means that the lender has already said no, unless the GC signs off. The GC won't sign off unless they can "guarantee" the work. They may be willing to do this if they think the work is sound, or they might come in and say they will sign off after they complete a bunch of work that they are paid for.

If John "completes a bunch of work that they ((sic))) he is paid for" it'll ONLY be because it needs to be done according to building code.

On this island it's difficult NOT to find a cheat, as is so exclaimed on this forum.

I don't know what it will cost because I don't know if it's built according to code and is worth the liability. I'm not suggesting he's one to NOT inspect and charge a flat rate for 'signing off'. My apologies if I gave that impression.

The rules say if you're owner/builder you have to wait a year to sell. If you want/need to sell before the year is up, you need a contractor to sign off on it. If you're owner/builder AND it's NOT permitted AND the year is not up then you have only added another step. Breathe!

It costs $0 just have 3 contractors come out, inspect and give you an estimate for what, if any, work needs to be done to be for that portion to be 'signed off on'. It's not that uncommon or complicated or anything to be feared. Owner/builders find themselves in this position sometimes; you are not alone.

If you don't have the $ to invest right now, you could get the bid/contractor you're comfortable with and ask for payment contingent on pending sale; they will provide a mechanic lien anyway so it's the same thing. The payment can be provided during escrow. If a contractor will not agree to this, especially in this economy, they're not the contractor you want anyway.
