TMT Construction Can Proceed
a contested case hearing be held regarding the granting of the NPDES permit

After the permit has already been granted. Lucky we live Hawaii.

As far as I understand, the NPDES permit was conditionally renewed another five years pending the receipt of public testimony. As you're aware, the public hearing had several individuals requested for a contested case hearing.

I think we can put aside the NPDES permit for the time being - it's clear a potential contested case hearing hasn't stopped the TMT from starting construction and whether or not a court says there should be a hearing, so many things are going to happen between now and then.

A second legal filing from TMT protesters has been made asking for a TRO and injunction against TMT starting construction on Mauna Kea.

"Construction is set to begin on Monday, July 15. However, the hearing for the TRO is scheduled for July 23, and the hearing for the injunction is set for Aug 27th, Pisciotta said.

“We are hoping the TIO and others will agree to halting Construction until the court has had an opportunity to weigh in on this issue and determined its merits,” Pisciotta wrote.

A voluntary halt to construction seems unlikely, given the state’s position on the lawsuit.
