Pittbulls - It finally happened to me
#61
afwjam,
Hawaii county has leash laws for the entire county, it actually includes having dogs strapped in when traveling in a vehicle, not that I have ever seen it enforced. By county law, any dog in Hawaii county must be leashed in public spaces, or (if I remember correctly) under control of the owner, which is a huge gray area. But I am one of the few people in the known universe who doesn't live tethered to a cell phone, and the idea that Hawaii county would send someone to deal with an unleashed dog when they won't send anyone to deal with a canine home invasion is absurd.

I agree with you about the value of having a well trained and well socialized dog, but I am not going to risk my dogs getting hurt, me getting hurt, or the other dog getting hurt if my dogs, who are a more than a little blind from corneal fire ant bites feel like I am threatened. My girls are sweethearts, but they think their job is to keep me safe, and when, with their limited vision they see a much larger dog literally stalking us, they raise hackles and form a triangle of protection with me as the apex behind them. They react differently when my husband is around, but if it is just me they think they are in charge of security.

I just wish people would understand that if you want to have your dog off leash you need to do it away from shared space. I wish we knew someone with a big fenced field, I would love to turn my girls loose for big long runs, but barring that I will keep them on leash when away from our yard, an acre is a pretty big dog run anyway. Again, the issue isn't really the dogs, it is the owners!

The county law does not apply to non-county property, I was under the impression that HPP is a privately owned subdivision. I agree with you the issue is the owners. So find a way to communicate more effectively with the owners of the offending dog. Something you can do as an owner is get control of your dogs, they should stand down when you want them too, you are top dog. There are classes that could help, I would be happy to help if you would like. When you get control of your dogs, you might feel adventurous enough to introduce them to other dogs and in this case, you could eliminate this particular threat entirely by socializing the dogs together.(which would help you socialize with the owners)
I know freedom and friendship work. Sounds like both owners in this case are not controlling their dogs, leash or no leash. If it is already illegal and the police aren't coming, what are you going to do? I suggest communication, socialization and friendship. I am not anti-leash or fence, I use a leash even if I don't think Hank needs it. It helps in particular with people who are obviously not in control of their dog, which makes them nervous, which makes their dog nervous, which makes Hank the most evil creature alive. Hank also has about 20 girlfriends in the neighborhood and a couple of brahs that get along great without a leash(thanks to socializing) People need to control and defend their ownself and property so that we don't all have to do it for them. Befriend these offending dog owners(and the dog) and help them understand, so they can still be free.

Here is a video of Hank running with the motorcycle:

If this is illegal, you better send the cops down here to fine me or throw me in jail.
That will fix Hank who has never hurt anybody or anything.
Oh and Im not wearing a helmet, the horror! Please protect me from myself. [Wink]

AFWJAM...
PLEASE READ county code 4-30....Obviously you have not yet & are a dog owner...

Normally I post the links I refer to...but just for kicks, I will allow you to find it, only because you seem to know everything already, so I am sure you can find it & will most likely take a few posts in a row on this thread to post your knowledge!

BTW - the leash code YOU are referring to above is county code 4-29... similar, BUT NOT THE SAME!!!

No problem, I have read it, I will copy and paste it for you.

quote:
Section 4-30. Penalty for permitting a dog to stray.
In addition to other penalties listed in this chapter, the owner of any dog which strays upon any public lands or the private lands of another shall be fined as follows:

quote:
Hawaii Revised Statutes 171-2 - Definition of public lands
Hawaii Revised Statutes > Division 1 > Title 12 > Subtitle 1 > Chapter 171 > Part I > § 171-2 - Definition of public lands

Current as of: 2010
Check for updates

"Public lands" means all lands or interest therein in the State classed as government or crown lands previous to August 15, 1895, or acquired or reserved by the government upon or subsequent to that date by purchase, exchange, escheat, or the exercise of the right of eminent domain, or in any other manner; including accreted lands not otherwise awarded, submerged lands, and lands beneath tidal waters which are suitable for reclamation, together with reclaimed lands which have been given the status of public lands under this chapter, except:

Why would you want to use the threat of physical force to control people? Assault is already illegal, why would you want to use force against someone who has harmed no one?

OK, you covered the public lands (according to the state...this definitions is not within county code) fairly well and it does nullify you insistence that the county code only covers county lands, as your definition has many NON-COUNTY lands which you stated earlier were not covered!!!..(BTW you may want to REALLY look at YOUR definition....as that definition may cover far more areas than you may want to imagine...."crown lands previous to August 15, 1895"....there are alot of people reading this that are living on lands sold, that were crown lands previous to 1895....semantics can cause slippery slopes!)

BUT THIS IS THE COUNTY CODE...county code defines public place in 1-4.a.28 and public street is defined in county code 34-3.a.12

Now, why have you ignored the PRIVATE LANDS OF ANOTHERS????

Your dog is not to stray on PUBLIC LANDS OR PRIVATE LANDS OF ANOTHER.....or maybe you did not read the definition for STRAY (CC4-1.r).... but you are so thorough on other things!

What is your end goal? To get me fined, put in jail? If you have a problem with something I am doing why don't you come talk to me in person? Do you always need someone else to carry out your will by physical force? What did I or Hank do to harm you that makes you want to harm us? Should we go after outside cats and their owners?(I have two) Dogs on a leash longer then 6 feet? What did they do to harm you? Why do you want to control others by force who have never harmed you? Do you fear my family so much that you would want to harm them? Whats wrong with these guys:
