The Daniel K. Inouye Highway is about 88% improved to Federal Highway standards. The lone segment that hasn't been improved is in between m.m 6 and m.m 11, which is above Hilo.
This final phase would entail reconstructing the existing roadway between m.m 8.5 and m.m 11 and re-aligning between m.m 5.3 (on Puainako Street Extension) and m.m 8.5. However, there is three holdout landowners in between m.m 5.3 and m.m 8.5, who refuse to convey part of their land for this new highway.
The HDOT asked the Land Transportation Division of the State Attorney General's office to start condemnation proceedings against these landowners in 2012. The Land Transportation Division has not initiated any litigation against these landowners-except to ask for more information a few months ago.
I'm posting this, so everyone is aware where things stand with this phase.

Sounds like a battle ahead...especially if they are rich landowners....which means it ain't going to be happening anytime soon....

These unresolved Saddle Road right of way acquisition issues are impacting the transfer of the Puainako Street Extension. The county constructed this highway with the intent to transfer it to the state's roadway inventory. The latter has not happened- even though its been open since Sptember 2004.
The State asked the County to acquire additional right of way, which the county is having difficulty obtaining.
The new east side Daniel K. Inouye Highway phase is slated to tie into Puainako Street Extension at m.m 5.3. Its likely one or more of these landowners holding up the last Saddle Road phase is holding up the conveyance of the Puainako Street Extension.
The three landowners in question are; Arruda, Towill and Alderson. Towill or his representartives refused to respond any correspondance. There is a cloud on the Alderson parcel, which requires ED action in both scenarios.

I'm not so sure. Some of these ED cases can get complicated and get dragged out. For example, it took the county 13 years to acquire the right of way through the Coupe property in Kona for the Mamalahoa Highway bypass.

Both of Towhill's parcels were already divided by the existing Puainako extension, and apparently the realigned road would split them again, so it's not surprising he's upset.

Thanks for the confirmation regarding the location of Towhill's parcel (The document I have says his name is Rick Towill). The new segment is slated to loop around Country Club Estates and intersect with the Puainako Street Extension on the Puna side.

Oops, you're right. The Towill parcels are 25045019 and 25044001, Arruda is 25044002, and Alderson is 25043015. Judging from these parcels being involved, it looks like the route will go straight through the old country club's golf course.

Thanks for the TMK numbers of the parcels that need to be condemned. It helps me out a lot to know where they are located exactly. The State has acquired the necessary right of way from twelve out of the fifteen landowners, which includes the State and County of Hawaii, according to the right of way acquisition document that I have.
