Joan was removed from participating in HPP functions after the incident with Susan.
First, the office has no idea who I am and that I am only an owner coming in for the audit.
Second, I'm sure that the audit will be subpoenaed by the terminated employees so your point has no merit.
Once again, these directors took an oath to abide by the bylaws and have no standing in restricting documents that they are obliged to distribute to the owners. A law suit doesn't change the bylaws or their responsibilities.

OH ENOUGH YOU ALL WITH ALL THE BS!!. Stop talking nonsense and get down to solve the problems HPP has for crying out loud: home invasions, theft, paying for roads that will never be paved, paying taxes for big 0 services AND the incoming flow of traffic from lower Puna and the free usage of our roads by no other than big yakuza county.

BS? How would you feel if a bunch of people took over and fired you breaking numerous bylaws and a number of HRS? laws?
Now they are replacing the fired employees with their friends and even the VP taking the GM spot after stepping down this is BS!
Stop crying about the added traffic. How about if you were cut off by the lava I think you would have a different perspective regarding getting to Hilo.

Who has been hired? Whose friends were hired?
When did the VP step down to take the GM position?
Are you spreading more lies and rumors? If these statements are facts, where is the proof? The VP is still listed on the HPPOA website. She has not stepped down.

With reference to the "Emergency Executive Session" mentioned above, it appears that the Board is again ignoring the Bylaws and walking into another invalid meeting.
ARTICLE VIII – BOARD OF DIRECTORS
Section 9. Meetings of the Board.
(d) Executive Session
1. Description
a. An executive session must be agendized, or be called during an open meeting with a motion to adjourn to executive session, a second and majority vote.
"Agendized" means put on the agenda of a Regular, Special or Emergency Special Meeting ahead of time. A Special meeting can be called with only that one agenda item. The Board will have to call an open Special meeting, with proper notification AND the participation of interested members and then can immediately adjourn to Executive Session.
Posting the notification on the website, while admirable, does not satisfy the regulation.
Out of curiosity, what conditions would cause personnel matters to become an "emergency"?

No not lies or rumors this is just my opinion which I am entitled to make, don't be so sensitive.
I thought you said that YOU monitor the HPPOA website?
The list of directors that you mention still has Craig in district one and Chris in district 3. The executive session that they are holding on next Monday will produce these changes. Why is it that there needs to be an emergency meeting?

Janet is correct, you can be a home owner and not a member of the Association. She is also correct about the executive session.
After six months they still can't get it right!

Frank, I wish I could help! I was told to my face by the President that," I am the President and I can do what ever I want". I have a witness to this remark and it is not hearsay.
A group of directors DON'T care about the bylaws and owners and they are on a mission to destroy our association.
You will soon see that the actions that they took with the fired employees is going to bite them right in their A$$, they still think that their actions are covered by the D&O insurance policy which they have not read. If you break a civil law (like an HRS)the insurance underwriter will cut their losses and drop the Association and them like a hot rock.
Furthermore, if the underwriter assumes that they did wrong they don't have to defend the Association or any director. Remember, the complaint by the fired employees is suing the Association and each named codefendant.......you know what that means. Each director will be liable for any court fees and awards against them without insurance.
This is standard language in all such policies. How can an insurance company pay someone to break a law?
