Mahalo again for all of your input. I did file for a TRO today. I had to jump through some hoops but it is what it is. Prosecuting attorney requested that my wife and I attend Mr. ****'s indictment tomorrow at 2:00pm. Yes I dropped his name, ohh well. :-) I did find out that there is a service that will let you know if the person responsible is released or is bailed out. Fortunately he is still in custody. More to come tomorrow after the indictment hearing.

Terracore, this is indeed a true story. Never in my wildest dreams would I think this would happen to me.

It looks strange to me, because that sort of thing happens to me A LOT... no need to dream. I could go on and on and on... if I tried to tell the story.

It is very important not to forget that anytime a miscreant threatens your person, family or property, they do so with a virtual army of lawyers that will pick apart and analyze every action that you make in response, the goal being to put you in jail or award your entire net worth to the miscreant, or both.

I don't believe that for a second. In the case of the guy killing a Marijuana thief by shooting him in the back with a shotgun while the the guy fled(a few years ago in HOVE); Prison.

BUT; Even with Hawaii's strict gun laws, I don't believe there's a jury on the Island that would convict a person for shooting someone in his home while being assaulted.

Between running for your life and blowing somebody away there are a range of options. Counter-insurgency trained personnel are familiar with the tried and true, as well as creating new methods appropriate to the situation. From what I've seen over the years, these bandit bands are allowed to exist because no one has determined to put a stop to their stunts. When professionals come in and take off the gloves the world will be just like they advertise in the real estate brochures, only with roadblocks and ominous SUV's roaming around. You get what you pay for.

yeah, civilization has failed us here as pointed out in recent posts. down with pesky laws and the judicial system, up with vigilantism. it's really quite a simple solution. good guys with firearms unhindered by red tape take out the bad guys. let's make a list of the bad guys shall we. i'm sure we can all agree.

It appears that many of you that have commented on this topic think you are within the law to shoot someone who is entering your house forcefully. Unfortunately, this is not completely true. You are only justified to use deadly force if you truly believe your life is in mortal danger. For example: if you wake up to find an intruder stealing your TV, you can not shoot him. Your life is not being threatened. The law clearly states that you can not defend property or material items with deadly force... only lives that are directly and immediately in danger.

In the case of UsGuys, it sounds as though a psycho with a machete was about to enter his house. If the machete was raised in a threatening fashion, UsGuys would have been justified to shoot if the psycho was coming at him. But, what if the machete was raised and the guy was standing still shouting obscenities? That would not be a justifiable shooting and UsGuys could end up in jail. In either case, UsGuys would probably be involved in an investigation where his belief at the second the gun went off would be in question. Having a legal background, I have personally seen this situation many times. All the focus is on the fraction of a second the bullet left the gun and if the shooter believed deadly force was the ONLY way to save his own life.

I once saw a case where a guy got mugged at gun point, stabbed the mugger in the eye with his car keys, and the victim did jail time. Why? Because the mugging was over. The guy had basically concluded the crime, so it was determined the need for deadly force was not justified.

So, for any of you who think you can shoot anybody who threatens your family, think again. It comes down to that very second, the overt intentions of the suspect, and what was really in your heart when you fired that gun. If it was anger or fear, you might be in trouble. It must be obvious that your life was in mortal danger and you had absolutely NO other choice.
