HPP Board 2014
So the HPP board has scheduled an "emergency executive meeting" many days in advance. I have done some research and there is no such thing. If there is an "emergency" using the real intended meaning of the word, the emergency would need to be dealt with immediately. So Obie, once again, the board is not following the bi-laws. They have disregarded the bi-laws so many times that what watchdog is saying does not need to be explained any further. After attending meetings for years and reading this forum, it is pretty clear that several people have not read, do not understand and do not respect HPPOA's bi-laws. Some of the comments are clearly ridiculous and then there appear to be a few who only care about certain bi-laws usually when it pertains to something they are interested in. Then there are those who defend the boards misdeeds and the most hysterical one was when one commenter kept denying there was a lawsuit while I had a partial copy of it in hand. BTW, it appears that the insurance company is NOT interested in representing this board yet didn't the board tell us all this won't cost a thing". Well they have an attorney and it is costing us ALL. How much? No one knows.I found out more information at the "Special Members Meeting" than any meeting this board has conducted. Many say it was a disaster. The only disaster I witnessed was the ineptness of the board and a few members refusing to follow "Roberts Rules". The Parliamentarian made sure those rules were followed the best she could amongst the disrespectful few. The presenters stuck to facts only. They certainly appeared to be concerned and care about our community. No one else has run a meeting like this but many saw an opportunity to attack instead of listen and base their comments on facts. To many seem to repeat things they hear via a misinformed person or through the twists and turns of the grapevine. I unfortunately hear more untruths about the "fugitive dust"issue and the "green waste" problem. It is like some one tells a lie over and over until they delude themselves into thinking it is the truth. Research before you comment and you will(if you actually want to) find the facts and they are not the acrid lies that have been spread. Particular owners who complained to the State caused US HPP home owners the expense and problems. I am NOT a ally of the "fired employees" nor do I fall into any of the stupid categories one poster here likes to do. I am a homeowner who is sickened by what has happened here in just a few months time. Say all you want about the previous boards; they did not get us into a lawsuit nor did they violate so many bi-laws it is hard to keep count or cause a divisive hostile environment. I do not know how anyone can defend persons that are suppose to represent us and ONLY oversee road maintenance but have violated the Code of Conduct repeatedly and are so disrespectful that we can hear them at meetings swearing to other board members, screaming shut up to members, playing video games during a meeting, wringing the timer over and over, letting some members speak on and on while cutting others off, talking over a home owner who was asked to answer a question, storm out of a meeting and slam the library door. Doesn't this sound like spoiled brat children? No wonder they won't allow video taping meetings anymore... They can't do anything right and refuse to try so they don't want any evidence. Their need for control and secrecy is like living in a communist country but remember, in their opinion we have to obey... they don't. Happy New Year!

Do you know for a fact that the insurance company has dropped coverage for the Association regarding this law suit?

I do not understand how a person with normal intelligence could describe this Board's repeated contravention of the Bylaws - which each Director took an oath and signed a statement (Appendices C and D of the Bylaws) to uphold - as "picking flycrap out of pepper".

It sounds more like an attempt to provoke an emotional response or to show off the poster's clever turn of phrase.

Thanks for the writing tips Watchdog. I guess I had a lot more to say than I thought. I have been biting my tongue for 6 months now. Hoping this board would knock it off (I was in denial)but they just keep on marching on their destructive agenda. I assume there are many more like me who have remained in frustrated silence.
I guess I should clarify a couple things. 1 is, I was trying to point out that on this forum the commentors who support the board and have no regard for the by-laws are the only ones who call names, make allegations that are unfounded, can not stick to the topic and always resort to pettiness. Their way out is to blame the old board and point the finger elsewhere.It appears that is the only way they can create the divisive environment they thrive on and have no intentions of looking at the facts.
Also, apologies. I am not 100% certain that the insurance company is not involved. Since the board doesn't tell us anything, I made the assumption because they have hired an attorney at our expense. If the insurance company was involved, that would be a waste of money and duplicate work and effort.
Lastly, it is beyond any rational persons thought process that this board has written and given reprimands to former board members. Some that have worked hard and honorably for our community.This just turns my stomach. This board should be writing and handing out reprimands to each other for all their violations and each have a pile 6" high by now. After 3 reprimands they should be removed but as I said before, this board has 2 sets of rules. 1 for all of us and 1 for themselves. If any of them had been treated as they have treated the illegally fired employees or the committees they have disbanded do you think they would have remained silent? With all the screaming and nasty looks we have witnessed so far when owners just want the by-laws followed... well you know what I mean.

I must point out that you are also finger pointing and you as well don't know all the facts Katarina. You're lumping other HPP Board posters together on this thread unfairly. If you've noticed, there are less board supporters now than there were when this thread started...???

It's more complicated than you may think. I don't know how involved you've been with HPP's committees and attending all meetings during this board and the previous board's tenure. If you've been as involved as I HAD been, you would understand why the previous board's behavior is mentioned.

The point is that the previous board weren't following bylaws, just like this board, and had become arrogant just as this board has. As I mentioned before, old timers say this has been happening for 2 decades. Very disheartening to hear indeed and something needs to change.

Yes, I was a previous board supporter in that I gave them the benefit of the doubt. Many members were delighted about the terminations BUT were unsettled with the lack of proper process and wanted the board to get on track following our bylaws afterwards. It became evident that the Pres and VP had the same MO as the previous exec board in breaking bylaws; making decisions on their own w/out full board knowledge and vote; or the board taking care of business in secret meetings no matter how many of us stated to them that it was illegal. The previous board also didn't conduct all their business at board meetings. Same o same o. It was very disappointing. When I say "secret" meetings, I mean outside of board meetings where business is supposed to be conducted.

And I haven't read anywhere in the bylaws where it states that the Pres and VP or exec board members can exclusively manage HPP excluding other board members in decision making. I'm confused as most exec members seem to have had this issue. Why would we need 9 reps if only 1,2,3 or 4 can make most of the decisions? Why aren't all 9 kept in the loop about all business? Otherwise, how can the reps properly represent their members? Am I off base here?

As stated in an earlier post of mine, when volunteers (board members or committee members) turn on other volunteers in an aggressive volatile manner, this is unacceptable under any circumstances, and their behavior needs to be checked. This is just one of the reasons why the Conduct Policy was introduced and passed by the previous board.

I had been harassed by an arrogant board member who thought he was above the law, in the name of defending his friend, the previous GM, and protected by the previous board exec members who were also his friends. 2 of them were witnesses to the verbal harassment at a Finance Committee mtg. The exec committee and 2 other board members didn't want to enforce the policy even though formal charges were made each time the behavior had occurred. Three previous male board members wanted the offender reprimanded and to resign, but he refused when asked.

If there was no conduct policy in existence, and he wasn't banned, he would've continued as he had planned, as a member on all the committees he was on, alongside myself in one of them. My only option would've been to resign after 4 yrs of service. There was 1 female and 2 males who didn't want to work w/him in other committees. He was the first board member that had consequences for harassing another long serving volunteer. It was well deserved and I think your stomach wouldn't turn over this matter if it had been you in my shoes. I'm appreciative that there was a Conduct Policy and that it was enforced against this previous board member.

I reiterate and agree with you that there are members on this board that should be charged using our Conduct Policy. i.e. Gross Misconduct.."significant levels of insubordination." A couple of them are knowingly breaking our bylaws.
