Can't talk and drive? I guess they should ban tour driving too then. Talk about distracting. I was a tour guide/driver in Hana Maui. Talked and drove for 10 hours a day on one of the most treacherous roads in Hawaii. and all while answering questions with a van full of tourists, pointing out landmarks,handing them drinks, changing the music, playing video for the kids. And yes talking on the cell.
I don't text though. That's where I draw the line.
One Thing I can always be sure of is that things will never go as expected.

Mindful - THANK YOU very much,true yes all.
We pull over every time n let them pass so they stey in front of us,way in front of us.10 car lengths if need be.
And let us not forget the self medicated amongst us.
Yesterday in longs by old safeway a man was buying 10 HUGE bottles of vodka,my wife asked him how long will that last or if is for party.
His reply was,oh my check came in so it should last maybe a week.Then she asked if he drove while drinking his fermented potato mash and he said of course he does,every one does,and besides he has never had an accident so no big deal.

Every day we pull over now at least 5 maybe 10 times from Volcano town to Hilo and let the cell phone self medicators pass and go over double yellow and then white line and back or run red lights and if when they pass us 10 times out of ten,their necks are bent over to below the dash level doing their cell addiction.

After doing some research about impaired driving I think that maybe I am Lucky, as some say.
I'm going to come away from this with a more broad way of thinking about my bad habit and break it, cold turkey. The ultra stiff fine has definitely put an abrupt stop to my cell phone use. And if it prevents me from having an accident , I'll never know , that would be a good thing. It's not easy having 300 bucks pried out of my hands in a few minutes. It takes me many hours of labor to make that much. and It represents about a week's worth of groceries to my family. Though I could have learned the same lesson from a $100 fine (What it used to be for the first infraction). It's the Greed of the District Court that raised the fine to almost three times that. And at the same time they made it easier on themselves to process. ( no more court appearance needed, just pay) And you can pay online with a credit card. How convenient.
Fines for infractions are one thing.
Laws that spawn frenzied police action is another.
One Thing I can always be sure of is that things will never go as expected.

It's a good idea to find out what the penalty is before willfully ignoring a law.
That said, I agree the first one should be a warning or maybe $100.

If you had simply bothered to get (and use) the hands-free kit with your cell phone, you wouldn't have this ticket in the 1st place.
Besides, what call did you receive that was so important that you couldn't wait until after you pulled over somewhere?

The notion that you are less distracted by a phone conversation simply because your hands are free is laughable. After years of driving on some of the busiest freeways in the world, I can tell you that distracted driving comes in many forms. From fiddling with the stereo to putting on makeup, from dealing with rowdy kids to eating fast food, drivers are distracted without breaking the law. Somehow using a phone is illegal and the previous examples are not! Be careful everyone, it's a jungle out there...

Study from AAA on cognitive distraction and how hands-free devices may not help. Again, while it feels like we can multi-task, the brain is really just jumping back and forth between tasks and can miss many details in the process.
