And the GM is taking a ton of time off. It does not take a rocket scientist to figure out why Jo resigned. She will likely take his place and get paid now.
That's VERY disturbing. I'd heard the GM wanted to get knee surgery at some point. If this does come to pass, we're in trouble. Being a fly by night interim GM for 8 months doesn't cut it. She was wearing 3 hats during that time and convoluted what her duties were supposed to be. The lines became blurred and she continued that path all the way through to her resignation as Dist 5 rep.
While interim GM, it became obvious she had no road experience and that's when all the trouble w/our roads began and has continued. She's the one who found and trained our current GM. She was the one who promoted Jaime from within to be the road crew supv.
Equally concerning is if new Dist 5 rep is supporting and aiding in this very concerning effort/agenda IF it plays out that way.
If this scenario has any truth to it....the board should be going to a temp agency for a temp GM, an ad should be placed in the Tribune, not just Craig's list, and take applications. Hire the most experienced person. If that doesn't happen, we're in deep kimchee.

One of those atty consultations reaped this board mantra stated by former board pres (2015-2016/up to Sep 2016) "The board can do whatever they want, the membership doesn't matter." which had been/is the board indoctrination."
Sincerely, M, I can't imagine an attorney saying such a thing.....and if I were the client, I'd head for the door.
------------------------------------------------------------------------------------------------
"From what I hear by many is this, "an atty will tell you whatever you want to hear" or "attys ask what you want the answer to be",
... if one asked me what I wanted the answer to be...again, I would head for the door.
------------------------------------------------------------------------
"and I've observed the atty's answer is only as good as the question."
It has been our experience that Good , reliable attorneys will bill you for the hours necessary to obtain a total understanding of the situation . If this does not occur, it is difficult to give sound legal opinion.
--------------------------------------------------------------------------------------------
"So what's the answer in getting good sound advice that's in the best interest of the membership, not the board."
I have been to our Board meetings, with an attorney present and I have wondered myself just exactly which party the attorney was representing. Served on a Board in Kona and the attorney there had the cheek to try and represent the Association and the Board simultaneously while The Board was being sued by the association!
The answer in Kona was money.......individual owners were willing to pay for their own legal advice.

You would expect to be able to voice your opinion but the Poisonous 10 don't want to hear or read facts, just want to spew their BS. Mr. SHOCKwaveRider, you are a liar. Yes we did have a conversation at the HPPOA Office. The rest of your story is laced with half truths and difficulties. As for Puna Talk, that's OK, keep spouting your vomit about the mailbox initiative. You are all so full of hate and disinformation you have no idea what the truthmentality really is.
I will not apologize to person's who hide in the shadows. I will not apologize for telling the truth to my community. I want to bring this community together and will not apologize to those who spread discord through their duplicitous promotion of self interest. I will not apologize for seeking legal counsel to determine the viability of filing criminal charges against those who have stolen our money or grossly violated the Bylaws of HPPOA."
Have I missed something? Is Puna Talk some different site or are you talking about Punatalk where your comment was posted (i.e., right here)? If it's this forum (Punatalk), then how come you can post your comment above but are not allowed to post a rebuttal? Would you be kind enough to explain?

TomK - the text you're quoting was supposed to be a quote - next graf she is saying that the 1st two grafs were what Mr. Sodan had posted on Facebook. Folks, it would REALLY help us when you quote another poster that you use the Reply with Quote button to avoid this kind of misunderstanding. Or, if your quote isn't from Punatalk, at least set off what you're quoting in some other manner. I couldn't figure it out at first, either, Tom.
And to reply to the statement by Mr. Sodan that people's attitudes were "Screw you, I have a mailbox," -- I haven't seen that attitude ANYWHERE - here on Punatalk or on FB HPP Next Door. What I've seen is a lot of people with questions and concerns. It's a shame this guy felt he was being attacked. Everyone realized the mailbox plan had good intentions behind it. What we objected to is how it was handled-- not going to list the ways AGAIN - we've all said them over and over -- and its poor timing vis-a-vis lousy road care.
Edited to fix grammar.

I believe you need to separate the two issues.
The people who don't have mail boxes should form a mailbox association and each contribute $150.00.Once they put in all the infrastructure (CBU's, driveways, solar lights )they will have a flood of people wanting to join their group .
Been there done that !

DTisme - thanks! Quoting and attributing stuff does seem challenging to some people here, so really appreciate you taking the time to explain, I appreciate it.

Well stated DTisme. That's pretty much it in a nutshell. Their priorities are upside down, their lack of knowledge of our bylaws and their inability to follow them, has become evident yet again.
Did anyone get a letter from the board apologizing for the faux pas and say not to send in any $ ? The board has had plenty of time to pull that together since we all rec'd our bills...Some people are looking at this as extortion and have sought consultation w/their attys.
There are plenty of members who live off island who have no idea that there's been some back peddling by the board, nor will be attending the membership mtg to get informed.
This warrants the board's full attention to remedy this ASAP w/a piece of correspondence to the entire membership. Yup, it would cost the association $ for envelopes, printing and postage but it needs to be done.
It's crystal clear that the board was premature about this whole thing, and needs to stop, regroup, do a lot of research, before they bring this topic up again.

Mermaid, since the board has decided to seek legal counsel on the question of their authority to assess the association $150/lot on a non-road maintenance activity, I would not expect them to send a letter to the entire Park retracting their previous and gross error.
I would think that they are going to wait on the legal opinion before they move forward. I just hope they report to the membership at the Membership meeting on the 26th (at 3:00 PM) on what was the attorney's "opinion".
Three possible ways that could play out: 1. they get the answer they want and will happily report it 2. the Membership doesn't hear anything about it from them, which could mean the attorney gave them bad news or 3. they didn't get the answer back at the time of the meeting.

Meanwhile people will be sending the board $150 along with their road payments to avoid 25% late fee.

My post was from postings on HPP Next Door Neighbors on Face book. I was just passing on Jerry Sodans disgusting, immature, irrational and lying posts. I commented below. As anyone can see, he knows nothing of what we members have been drug though for over 2.5 years. His viscous attacks on the fictitious 10 show he had no intention of representing the entire membership. His willingness to sue and go to attorneys over everything was a red flag. Funny how some love spending others money but would never spend their own. Expect more of the same with the boards hand selected appointed board members.
I could be wrong but the man who posted that he is happy with the road crew because he got his road fixed coincidentally became a recent appointed board member. See what you can get when you play in the dirt.
