No new building will be allowed in Leilani.

Reported in another local forum:

Norren Kato of the Planning Dept. says that no new building will be allowed in Leilani. Only permits will be issued for repair and maintenance. Norren said the Planning Dept got these orders from the Mayor's Office.

Sounds like Generalissimo Kim is still handing out edicts with no concerns for anything more than his hidden agendas.

The county was complicit in the creation of the Puna subdivisions including Leilani.
Now they look to be disallowing property owners from building on their property.
So, it seems that means that no building permits are needed to build on your Leilani lot any more.

If true, this will indeed result in the lawsuits kalakoa predicts. Should the other Puna (and Kau for good measure) subdivisions stop their internal bickering and join in a class action lawsuit piggybacked onto a Leilani action, they might bring down the whole house of cards the county illegally set up when the subdivisions were founded. I'm not holding my breath, though.

A lawsuit they will lose.

The CoH is ripe for some legal challenges.

The Generalissimo better have a big checkbook for all the property value he is destroying. And the litigation he'll be forcing to discover just what the Takings clause of the Constitution means in the 21st century. Then again, his political affiliation holds little regard for any Constitution anyway. And Puna's representative doesn't likely believe US law is valid on the island anyway.

All this means is that the most of the construction will end up un-permitted. Nothing new for Puna.

Being as there was as much, if not more, property damage in LZ2 as in LZ1, plus things said before by our dictator about wanting to shut down both LZ1 and LZ2, has he shut down building in the LZ2 areas also?

Valuations for tax purposes are zero.

Trust me, leilanidude, they'll find a way to extract their money.

Not to hijack the thread, but has anything been decided about home insurance in the highest risk lava areas in the future? My guess is that most of the unpermitted houses likely to be built under Harry Kim's presumptive edict will also be uninsured. I think the availability of insurance, however expensive, caused some people to build or buy there who wouldn't have otherwise.

And there is a precedent in the making. The Aloha Safety Checkpoint was built (and rebuilt) without a permit, and Senator Kahele is looking into whether a law allows government to remove the building. If not, presumably it should stand.

State Senator Kahele said he was surprised to see the structure was taken down a few days ago, it's since been rebuilt.

Senator Kahele wants to find out whether the law allows for the structure's removal.
