I drove by last night and your lot looks good. I would give him the info about loosing his guns if you file a complaint. If he doesn't back of then go a head an file.
And I would build a solid 8' fence right on your property line in front of his lani. Remember you need a permit for that and I would install it at the very end of your construction.

Yeah thanks Scott, however, we've moved backward, and actually the lot is in a bit of disorder, ha.. Still yes the direction we are shaping it, from it's original very poorly grubbed condition as you might have noticed is coming along very nicely. Creating a none traditional variation of shaping our lot is expensive, but it is also something we had hoped to become an enjoyable living condition..

At the moment we are not so sure we'll have the luxury of enjoying it..

Just about anybody who is interested in seeing it is welcome to drive by; the corner of Opelu st. and Puni-Paka loop, You could not possibly miss it if your were at this street intersection, Hawaiian Beaches subdivision, 6-7 blocks before the ocean.

However please do not feed the locals..

I think once the house is built and you are in it things should calm down. As you know we live in HB and our neighbors are close to. You can have as much interaction with them as you want. We are very fortunate that we get along with all of them. I hope to see you one day working on the lot and house because Jayne and myself drive by a few times a week. If not please come to our Puna Web Party on August 12 and I'm sure you will receive alot of support from our internet community.

So, after all this deliberation, frustration, etc.. We tried to go back to work today, another ten days of our short stay lost,, . We'd bought around 40 podocarpus plants over a month ago. The idea is to grow them as fast as possible, and 'Maybe' we can get to the 'out of site, out of mind scenario'. The eight-foot fence/wall would be to ugly, maybe faster but ugly-ish. Not to leave out the north neighbor already has a four foot wall, if we built an 8 right next to it, they can just stand on it their 4 footer, problem not solved..
Bad part about the plants though, is that we will be giving up extra space, it’s only a 12,100 sq ft lot, but we like plants.

So, anyways we had planted three podocarpuss to grow in the area where our avocado tree was, in the corner by our north neighbors a few months ago, small plants about 1 1/2'. Plus we got some really nice hala-conda that will produce some lovely large and long lasting flowers. Anyways,

A few months ago, we planted a healthy stalk of bamboo, none invasive, at the rear of our yard a few feet away from the south neighbors wall. However, a few weeks ago we noticed the one and only leaf on the top of the five foot stalk was gone, and the tip was chopped off. "ah" we thought " coincidence" or something.. But today we took a closer look. We had six pieces of bamboo root, and one stalk which had the best, largest and strongest root. We placed the five root cuttings in a 2 gallon pot, and planted the stalk with the same mulch in this area, because it had the greatest chance of living. While the others were just chopped roots.. Today we took a closer look at the planted bamboo, and it's dead. However, the other pieces of root are all growing, sprouting small stalks over a foot and a half... I was thinking, "No, it can't be dead, maybe they cut the top off but kill it? naw.. that's pushing their luck"" "besides I couldn't possibly prove that"

Anyways, I figured I would take those three podocarpus from the north side and plant them with the rest, south side. Pretty small compared to our large group of 36, which are each 4', and I'll put them in the shaded areas on the south side of lot. can you guess where this is going? Yup, poison, Two podocarpus were sprayed and the surrounding srubs are dieing. and one of our hala-conda too, planted about 2 ½ months ago, which was very happy just over a week ago are dieing too.. and the surrounding shrubs..



O.K. whatever, right? It gets better..

So we are in the mist of planting these podocarpus 2 feet from the south neighbors wall. I've learned that it will be about two years before the leaves begin to grow over their four foot rock wall.. That is, grow into their air space..

While I am taking a break, the south lady tells Mayumi: "you understand that we spray weed poison from time to time to cut down the growth on our wall and it will probably, get on your plants." And, Mayumi politely tells her that; she should probably pick the weeds so she doesn't get poison on our plants. But nope, this lady insists she will spray poison “and if it gets on our plants, well that's too bad”.. I tell Mayumi to "just ignore her", because it's becoming obvious she's starting to get on Mayumi's nerve.. Then she directs her voice to me, telling me to come over there, rather than yell across the lot and so that i can hear her better. I told her I can hear her just fine, and that she can not spray poison on our plants,, as I go over.. Once I am there she begins on about poisoning our plants. I tried to explain that this will be much better than a 8 foot fence, but apparently to def ears. I tell her, she can "spray all she wants but do not get it on our plants" And do not spray poison on our property. . And, "I sprayed the entire lot all around killing weeds and stuff everywhere, including up by the wall.." "however", "As you can clearly see i was very careful to not get a drop of spray on your plants."

They have several pots with plants on it, and things growing on the wall plus ivy.. So, she says she's gonna spray, and Bla, bla, bla,, same thing.. I tell her again, "if you notice not even one leaf, not a plant nothing, got any spray, I was very careful and not one leaf on your plants got the slightest spray on them" That, as long as she shared the same courtesy, I didn't care what she did. She's like "thank you" but I will probably get spray on your plants because we spray poison up and around the weeds that grow on our wall..

Well folks, there's no weeds on their wall, no weeds on their property, no weeds to spray anywhere on their side of the property.. Nothin, zip, zero,.. natta Their yard is very well groomed I don't think a weed even gets a chance to sprout without them noticing it and yanking it out.. Nice grass and plants around it, and moss growing atop the wall, which is perfect healthy. There is absolutely no reason to spray weed poison anywhere near, on, or over their wall.

But our bamboo, two feet away from their wall has been sprayed and dead.. Plus if you are thinking on how i am now thinking, Duhh,, the plants on the north side? Those three podocarpus and hala-conda,? This south lady is now clueing us in on exactly why those are dying too.. Team work.. I guess i was wrong about feeling sorry for the north neighbor, thinking she was set up.. now it's obvious it's still a Team..

So... seeing as i am talking to them, I try and take this opportunity to explain about the TRO. A-N-D, the only reason i have not filed for it is; "because your husband will loose his job" Which is well received and volley returned: "If my husband looses his job because of you, YOU WILL LOOSE!!!"" Then i plead with them "Please listen to me, i am trying to be as compassionate as possible, I do not wish to do this" which is retuned volley, another threat..

I try and tell them that, when we build and live here, the plants will grow and provided a nice pricy screen. Again she returns the volley. “you won’t live here!” I was ‘like’ “what” she said; “No, because you will not be living here” I said: “so, you are going to prevent us from living here?” and she said “that’s right!”



Soo... Now this south neighbor calls the police on us, bear with me cause later on while trying to figure out what their complaint is, we learn, the officer is not sure what or why they called, just as much as we are..


HOWEVER, this lady tells the police that their property line is 10" on the other side of their wall. (our property side) T-h-a-t, WE moved the property marker monuments.. plus goes on to say that we moved the boundary marker on the north side, opposite from these people across our ot, And that: they intended to "cut" the leaves "if and when" they grow over their wall.. With the police officer standing next to him the husband begins telling me about if I understand that when they grow over his side he's going to cut them, from there. I told the officer, “Yeah but that's not what they said they were going to do, they said they were going to poison our plants.” I was a waist to try and talk over her B.S. so.

We just kept planting while she blabbered her lies to the police, and waited our turn.

I figure, best to let her spew out the lies and when she’s done, we have our turn, we’ll show them the truth and evidence to support it..

We got a survey report too, now registered with the county.. Move which boundary line where MRs north neighbor? Ha!! Evidence and documentation speaks louder than running mouth..

Unfortunately, the police got a call before we had a opportunity to thoroughly up-date them on the scenario.. However, I just got off of the telephone with the reporting officer, and he said he would go talk with them and inform then that I am being "lenient" and will get with us in two days when he's back on duty. That he will complete a whole new document for court records..

Now for the good part.. Hawaii experience in spit of these people..

HAWAIIAN SNAKE!! yup there's snakes here...

Under about six inches of dirt, there's this little worm looking thing. But as i scooped up with my shovel it was 'like' weird, too odd for any worm I ever saw. squiggling far faster than a worm, So anyways, i shot photos of it.. Looks like a worm but up close, which i couldn't capture with my crummy cell phone camera, there's a tongue slithering in and out of it's mouth.. Cool... Hawaiian snake..

They are about the size of a slender worm although much longer, maybe 6 inches long.

BTW, I hope yaw'll don't mind, but seeing as this thing with the neighbors keeps dredging on and on, main reason I have been continuing posting starting from the filing of harassment charges on them, is; documenting what’s going on.. date stamping the events, with a completely unbiased logging and timing system. Too, in order to preserve safety, and privacy, I do not write these parties names. Rather, although at times perhaps confusing; refer to them as south neighbor, north, south lady, north lady, guy etc. And trying to be as specific and detailed as I can recall..

Maybe it'd be better to NOT plant anything. Erect some modern art in the middle of your lot (very heavy & very noisy -like giant wind chimes) and coat it with indelible dye. Anyone who touches it can answer to the local police! Then, after you build (and what will they try to do to the construction in progress at night?), it'll be a clear view at their place & you could keep an eye on them! Get a big dog that barks at strangers, motion detectors attached to a siren, (maybe you'll have to place the dogdirt along the property line) and some of those camo hunting cameras?
Wow, that's some hostile (non-aloha) folks, for sure!
Maybe drop a hint that, when they have to sell their home (since he won't be working), that you're planning to buy it and tear it down - its a blight to your scenery?

Ditto to Pua'a. It's time to buy an inexpensive pocket recorder and get some of this belligerency preserved for posterity (and the judge.) It should not be too expensive to establish the true boundaries of the lot, either, assuming that you haven't already done so. Plenty of ads in the paper for guys who do that, or better yet, ask the Punaweb community who's good to do it. Those folks need to learn some lessons on neighborliness, aloha, being decent people, and so on ad infinitum. It might take a court order and losing a job to do it, but whose fault would that be? Not yours.

Build the fence and I would like to see them poison that. Any damage that would occur along the property line would be attributed to them. Why else would anyone damage the fence?
I would block their view RIGHT NOW and let them deal with it.
Moreover, when I drove by the other night the south neighbor’s lani seems very close to their wall and assumed property line. Is it set back 10’???????

Yeah, thanks Scott, But there's more than the ugly factor in the fence idea. Can't forget their rock wall is 4', then to go 8' privacy, guess who has to approve it? does 'the neighbors' come to mind? Yup, then, well, go and try to get the county to approve it because of a domestic, which does not fit into domestic classification, neighbor dispute.. Yaw think the county building department is gonna approve that idea? not.. County ain't gonna get in the middle of any neighbor disputes.. Not killing the idea, but I have thought this out very well.. We have had now, months of inactivity due to their malice..

I 'thought' because it will be two years before the plants, the bottom area will spread out far enough to get above and over their wall, air space, I'd have plenty time to raise them high enough and deal with the expected threats of making me pay to trim on their side, would get the job done. Obviously not if they are blatant enough to go right out and tell us they will poison em.. Police point of view, "not sure if it's property destruction or civil", 'likely civil though'

Their patio is 4'feet high, six foot fence aint gonna get the out of sight out of mind.. Actually it would probably give them a good laugh, "waisting time and money, Mah ah ha, ha, ha!"

Yeah, checked that patio last year, I thought I was or could be prepared for these people. it's right 10' 6" away, fully permitted etc..

Today was the most enlightening information we've discovered.. After now having four interactions of this guys wife, and all of the other things involved, I found her profile.. It's called psychopathic bully.. Her husband fits the profile of the type a psychopathic will cling to, Mild-mannered, a puppet on a string. I suspected this a few months after he began calling, then the co-workers, deal, and more when she called and threatened Mayumi. The north neighbor lady fits the bill for who she enlists, and her job at Wal-mart also fits the profile and how, what she does to maintain.. plus after listening to how she lies, migrates her stories, then flips over to Mrs sweetie in front of the police, she's got 99 percent of this profile. This is one serious sicko. Whats worse is I fit the profile of the type a sicko like this, hunts for. It's a game for her, malice, lies, deceit, deception, Jekyll and Hyde, seriously.. Check out the web site 'bully online', several profiles and she's in the top of the list, worse kind..

They specialize in using laws, guidelines, rules policy against their victem.... Where as IF you can catch them, they have a complete and total disregard of law and order..Laws for this type of sicko, are only good to do your victim further damage. Catching them is the most difficult task, and there is not one single group who has a clue on doing this..

I can not believe this,, but, fact is, we are seriously screwed.. At 53 years old, she's so practiced at this. Like a game of chess for this type of sicko, premeditated, malice.. Me being exactly the type of personality, caring, compassionate, honest forthright, stand up for my rights, etc.. like a chess game, I am not even a beginner in her sport, while she's an expert..

Get the voice activated recorder tomorrow. I'm sure Wal-Mart or OfficeMax has them. Buy a camera pouch (or something innocent looking) that it fits in and modify the pouch so the microphone works. Make SURE that it works and get a good feel for the distance it capture voices from.

Strap it on along with a pair of pruning shears so it looks like part of your gardening attire. Mosey out when he and/or she are outside. Remember this will record any noise it picks up. So if you have it on and are moving around too long before you see them, evey cough, sneeze, shuffled foot, car door, bird, etc., will run the tape.

Let one of them make the 1st verbal contact. To establish date and time, get on the tape something like "Today is what... Friday the 22nd? It is only 1 PM and you want to go over this again?" Then keep very calm and let them rant. Don't bait them. Let their personalities come through.

I wouldn't tell them after the fact that you got them on tape either. Knowledge IS power.

If you go them in a tirade and you needed this tape as "proof", is it admissible in a court here or for getting that TRO? Consult a local lawyer.

Just my 2 cents. And remember that advice is worth what you pay for it.
