Hydro-Electric From Stream

If you have a stream on your property, is it legal to tap that stream for hydro-electric generation? Is the stream considered yours to use as needed or must it remain free flowing?
I can't find any info???

(I did a research project on this last semester...If your wondering why I don't just give you a straight up answer.... water resource legislation in this state are not as clear as in some other states, partly due to the traditional governances on water rights. 'It depends' is more likely to be the answer you get....and it may even be, 'it depends on your Environmental Impact Statement' (something I don't think you are wanting to do)

Thanks Daniel, I'll give you a buzz when I come in September. I was more curious because a stream (may be seasonal)is indicated on the property and I figured, what the heck, free electricity. (To be honest, the cost of those things floored me)

I'm curious, where in Puna is there a stream that could be used for hydroelectric?

I have not entirely walked all the properties to see what is really there. I did see a funny line on the property map and it appeared to be some type of gulch or stream. A nearby MLS listing had "stream" as a property feature. Honestly it just might be for rain run-off and is dry most of the time. I'll know in September. Don't want to ignore the possibility for any free electricity.
