As I understood from planning dept only two sub CCR's are enforced - Discovery Harbor and ? cant remember the other one but it wasnt Leilani.

the whole CC&Rs thing is not that clear, they are contract not law. the gov can not enforce them unless they are conditions of a planning agreement
i have seen deed restrictions that are clearly illegal ( like only people of a certain race could live there ) The devil is in the detail

Yes John that is exactly what I meant!
(except for the court part which I dont how far it has been tested although the 22' height restriction in Leilani has been tested and lost, correct or no?)

Contracts, including CC&Rs are enforceble in court. Only a few things like racial discrimination or other explicitly prohibited catagories of discrimination would be voided by the court. So, you may get permission to build, but the home owners association can make you tear it down.
