It may be the Beachlots Community Association that are the law breakers here. There was traditional access to the shoreline long before the subdivision was developed, and property owners are required to grant egress to others.
I really miss Jerry Rothstein and his persistent efforts to protect our rights to shoreline access.(He was tragically killed in a car crash in 2005)
Jerry was founder and president of Public Access Shoreline Hawai'i (PASH), whose lawsuit over a coastal development in Kohanaiki resulted in a 1995 landmark Hawai'i Supreme Court decision affirming Native Hawaiian gathering and cultural rights on private property.
