Actually, everyone is being recorded and not listened to in real time, later on, should a specific individual fall under the suspicions of any of the "Alphabet Gangs" (or their privatized counterparts) the "target's" communications will be further scrutinized, 2 hops out.

In Hawai'i these "free" cell phones are being marketed under a "Tribal Resident" plan, and the cost for those eligible is $1 per 1000 minutes/texts per month.
The phones are using T-Mobile infrastructure.
