There had to be another factor involved. An unlicensed contractor is just that a contractor that does not hold a license, but not necessarily operating illegally. A person is allowed to perform "contracting" under certain conditions without a license under the law, and they are legal. So maybe it was for a defective contract, outside the scope of the exemption, or the aggregated total exceeded the exemption. Just because they are unlicensed is no singular grounds to throw out a case absent any of the other factors.
