This is outrageous! What kind of precedent will be set if other Representatives see one of their own actually serving their constituents?

Why would anyone even want such a person as a representative? They could be pulled away from the congressional floor on a very important vote where you are no longer represented. Such a circumstance can be used for or against a represented state.

Not until Nov 13th at the earliest. That's the date of the next House session. She has almost two weeks to serve without any interruption to her duties as a voting member of the House: http://www.house.gov/

Not sure on the legal answer, there maybe something about if the guard is acting as the state? .
But they do not seem to teach civics here. How government should work. I wonder what percentage of the population of the state has read the constitution

Seeb, it would appear the UCMJ does allow for retirees and reservist to hold such positions if not called to active duty for more than 270days and that the position not interfere with their military responsibilities.
It does however appear to be in conflict with article 1, section 6, clause 2 of the US Constitution.

I think it would be in conflict with the US Constitution if the Hawaii National Guard had been federalized by the President, but it has not been federalized and is still under the control of the state.
