So Damon, if I understand what your saying, the 14th Amendment would prevent government from enacting any legislation that would derive me of my freedoms so long as I declare the action as my personal liberty?

No that's not what I'm saying

In other words, I can use the rights to drive drunk and government should not have any say to infringe on it so long as I declare it my personal liberty?

Yes, you can drive drunk all you want, as long as your willing to sufer the consequences. That's your choice to commit the crime and face the punishment. Smokers do it daily with the risk of cancer, emphezema, etc.

So if I choose to build my own incinerator on my property next to yours, and I'm burning carcasses as fuel, so long as its my property, and I declare it my liberty, government has no say?

Happens all the time (you may not realize it though) I used to have a "smoker" on the mainland to smoke salmon... that would stink up the neighborhood. My ohana on the big island is constantly using there imu.

That if I’m at the Pond and I relive myself of breakfast behind a bush, government has no right to infringe if I declare it my personal liberty?

They aren't doing it at champagne pond

That I can drive a coal powered vehicle as my liberty, regardless of the pollution it emits, and government should have no say?

Isn't Gas a derivative of Coal?

Is this what your saying?

Look I know smoking sucks. I just don't think government should regulate it so much.

Damon, 'Gas' (gasoline...) is a refined product, distilled from crude oil. (Natural gas -LPG) is normally withdrwn in the same area as crude oil). Crude oil is from fossil aquatic invertebrates (mostly dinoflagellates). Coal is from fossil peats, and is graded by the fossilization, there are waxy coals all the way to the stone like anthracites. There are researchers looking at making a gas from coal, but that is not what you are using at the moment...

tongue in cheek quote #2....

It's not about your rights as a cannabis smoker to harm yourself.

If you develop some way for your cannabis smoke to stay within you or your property and never invade the body or property of another (especially with issues of harm to others from second hand cannabis smoke) government would have no legal basis or ability to ban what does not impact others.

If you're looking at this as your rights as a cannabis smoker, you’ve missed the point. It's about the rights of non-cannabis smokers to be protected from your cannabis smoke.

Oh wait, except for medical marijuna, cannabis smoking is already illegal. But still yet.....

Well it is clear we all have our agendas no!

But I say share the wealth of sin taxes to diamonds, luxury boats, hard liquor and such. Cigarettes should not be the only go to place to extort taxes, fees and paint consumers with the scarlet letter!

I smoke, never inside and am very courteous to those who don't, don't litter even though my new car came without a cigarette lighter or an ashtray to put the butts in! I'm sorry it is an addiction one I wished I never picked up. What is your go to addiction, TV, food, beer, the gym?

However it is a legal product, not welcomed in bars, or pool halls anymore but say hey, in CA there are counties who ban people from smoking in their own homes, condominiums in Burlingame and such places. What is your bad habit and will it be banned too?

Oh well! Damon when we get there we'll have you over to dinner! Hey bring your smokes will ya, maybe need to bum one or two! LOL

Mella, You seem resigned to live out your life under the addictive yoke of nicotine. I assure you this isn't the case.

While it is very difficult to quit smoking, the rewards are commensurate to the effort.

Aside from the obvious health, aesthetic, and economical benefits, you will develop a feeling of empowerment from not having to light up.
This natural high is much more satisfying than the temporary high from a drug.

Believe me, it's well worth the work, and while difficult at first, gets easier and easier as time goes by.

Be a quitter.

I quit a little over a year ago after 30+ years of 2 packs a day. It was REALLY hard to do. I had all sorts of respiratory issues and every minor cold progressed to major bronchitis AND I turned 50. I have a wondeful partner in my life and we bought a house together in Hawaii to retire to and I wanted to be around for that life after working hard for so many years.
NO ONE believed I could do it except Carol and ME. I used every quit aid I could lay my hands on at one time or another.
It is the second best thing that has ever happened in my life.
I swore I wouldn't be one of "those" ex-smokers who lecture those who still smoke and so far I have resisted the urge but, since you asked; it is a vile habit. Smokers stink. you are killing yourself. Cigarettes should be outlawed. Tax away. Ban them every where.
Thanks for listening. I will now step down of my soap box.

I heard on Oprah's Quit smoking show last Monday that the average person who wants to quit... does so 5-6 times before they actually quit for good.

It took many attempts for me. The important thing is to keep trying and not get discouraged by a setback.

It's also important to consider yourself a "non smoker" and not just "cut back". Use whatever aids you can to help.

Do physical and breathing excercises. Drink a lot of water. Reward yourself with a treat once and awhile.

I'm not joking; it gets easier and more rewarding with everyday that goes by nicotine free.

When I see people puffing away now, I just shake my head and thank myself for stopping.

Good luck.
