Yes, perhaps like the fellow mentioned a few posts above who needed all of December and half of January to celebrate "the holidays," counsel in this instance requires a good portion of October to organize and construct his extensive Halloween decorations, both inside and outside his home. It could take awhile. Will the judge grant his motion a treat, or rule it another trick? No fathers or mothers think their own children ugly; and this self-deceit is yet stronger with respect to the offspring of the mind. -Miguel de Cervantes, novelist (1547-1616)

quote: The protesters in this case have rolled boulders by trying to delay everything from the beginning. They had to push out the site visit, they had to change hearing dates, etc. So far things are off by about 4 weeks from the original schedule. This turn of events doesn't surprise me as many of those filing have tried to delay the hearings multiple times. I see Wurderman's filing as another ploy. How many cases does he have that have this high of profile and a $1 billion dollar project at stake? He can certainly move things around if it was in his best interest but it isn't. The judge has expressed multiple times that this case will be resolved in a timely fashion. ...CRYING FOUL” AND THE PUBLIC FUNDED $380 AN HOUR HEARINGS OFFICER AMANO... Delaying the case and then complaining about public costs is pretty hypocritical.

Where did this guy go to law school? Has he ever actually practiced? Sounds like he does not practice professionally. His grammar is not what I would have expected from a practicing lawyer. Granted it should not be the case that whoever has the most money wins but every game has rules and standards. Sounds like he is just not up to it.

Yes: construct a new resume, organize a job search.

Most of the recent documents submitted today are all about getting the hearing officer, Judge Riki Amano, removed. The latest document puzzles me, but probably because I don't understand the law system that well.
https://dlnr.hawaii.gov/mk/files/2016/10...-Kahea.pdf Two people have announced they are now co-counsel for Wurdeman even though he's withdrawing from the case. They seem to be from a legitimate law firm, so am assuming they are sitting with him just to get caught up. I guess I'm asking anyone with law experience; is this the way it normally happens when a lawyer withdraws from a case and others take over?

I couldn't copy and paste this, so hope my typing is accurate, please forgive me if there are minor innacuracies:
https://dlnr.hawaii.gov/mk/files/2016/10...reitas.pdf "My responsibility to meet HO set schedule, has put me in a state of Anxiety, stress and physiological injury. My responsibility to my employement has been burdened by this impartial Case. All Advocates for development and corporate lawyer are pushing this case without allowing petitioners to have a None bias due process of law, thereto, with obvious support by Hearing Officer in contested case hearing. Threat, Duress, and Coercion is being put upon me, and my right to be heard impartial."

The Trib is now reporting Wurdemen's withdrawal as counsel.

Thanks, Justin.
In the meantime, this article, albeit brief, is a fair summary of the TMT's options right now: http://www.sciencemag.org/news/2016/10/h...s-new-home |
