Isn't this America? If it is zoned legally... why shouldn't this person be allowed to operate a business?

Its America, where we use the ostrich approach to our kids. We protect them from knowing that there is a store selling "adult" items, thereby preventing these same kids who are busy "sexting" from being exposed to sexually oriented adult business. Go figure.

my opinion;
very bad ideal....some might like many dont. if it came to vote i bet it would fail! think about it....all the people each day passing by it with kids of all ages.
poor choice of location. and yes many strange types do hang around these joints however some are normal folks ill give you that.
i always thought if it was offensive to people it should be elsewhere. American or not! In my profession as a youth counselor i seen what damage is done to families when these types of places are around a small community. maybe the best thing for a person who desires this should mayb ebe internet orders. adults sometimes need their entertainment!
think about the good it brings compared vs the bad it encourages.
5 year old daughter to mom...mom whats that store? think about it for awhile and then prove to me its a positive thing for tne community.

Once again, The owner is not displaying his wares in the window, there is nothing for these "impressionable" children to see, its a legal business. And who has seen these so called " strange types" hanging around. How do you differentiate strange types here in Puna, I'm curious, do they wear a tag, or what.

"Strange Types!” we're talking Puna. That's practically the whole population. Have you seen the "strange types" associated with tattoo parlors? What about the "strange types" that go into bars and come out even "stranger types"?

dick i see you r point but...in my opinion your not thinking like a parent or a person whos been damaged by these types of places. explain to me why have dark windows if its such a OK place?

we are talkin about SEX/toys and porn... not tattoo or a cold one! having a young granddaughter and three daughters puts me on the "no its not good" side. i guess this one hits me at home so ill move on.

And so we protect our children by pretending sex doesn't exist? And who are you to tell someone they have to use the internet to purchase lingerie, as opposed to visiting an adult store. What does this same woman tell this 5 year old when she passes Victoria's Secret in the mall, or turns on tv? And this so called connection between sexually oriented businesses has never been scientifically proven to exists anywhere but in the minds of those who wish to impose their standards on someone else.

And we have dark windows in these places because Americans try to pretend that sex doesn't exists and if we all just ignore it, our children will not discover it. And as an aside I have 2 boys and 2 grandchildren. These darkened windows are imposed by these same people who can't tell their children that sex is a good and natural part of adult life. A problem my wife and I never had.

I think that the issue for the Shipman company is not the location of the store in close proximity of the school. Their issue is that as the landowner, the lease of the land had specific requirements that the shopping center (the tenant to the Shipmans) did not follow in leasing out this shop.

If the contract is as stated in the articles I have read on this, they probably should have been notified of this potential use of their land prior to the sublease...

I'm guessing B. Orts would have more knowledge than I on this, but I do think that a landlord can set certain parameters on the type of retail establishment allowed on their lands.... and it seems that this is a case where they are asking the court to determine if the lease parameters have been exceeded.
