Need an attorney

I am not new here, just signed in as a new user for this question as it is very personal and hurtful for us to even have to discuss this.

Does anyone have any knowledge of a good bankruptcy attorney. We have found two we are looking into but just do not know anything about this and you guys always come to the rescue.

Same ones, which is fine, I just needed to see if someone had a good opinion of either one. Stuart Oda is easy enough to get in with, the other one has a bit of a wait list. I have been reading the stuff you noted all week so have a pretty good idea where we are right now.

I don't know much about bankruptcies (fortunately!) but I sure wouldn't go at it without an attorney.

Clona - I can't offer any advice, I have no knowledge in this area, but I'm sure I speak for a few people here who understand the feelings you have right now. I work in a field in which I did not expect to see so many people made redundant and it is through no fault of their own, and they may end up in a similar position to you. All I can say is good luck, I hope everything works out in the end for you and of course you will always have family and friends, the most important thing.

A person can file their own bankruptcy or get a preparer to do the schedules, but to go in there against greedy trustees without an advocate would not be wise. One thing to know is that the Court can reject the filing, and if you go in pro per they will watch you like a hawk looking for errors, errors I bet they wouldn't blink at if an attorney made them. I have filed a civil lawsuit pro per and I know whereof I speak as to how rough they are on you.

Interesting, clona, that they were the same two. I guess there is not a lot of selection. After they "reformed" the laws (2005?), they put a lot more liability on the shoulders of the attorneys, so many stopped doing it and the fees went up. Sally Kimura in Waimea does it too. I guess some people like her, but I once had a consult with her on a different type of matter and she didn't wow me. I paid her and then found someone else.

To my mind, Mr. Oda has a lot going for him because he knows all the players and is a player. (I just checked his site and he's been doing it for 40 years.)

We met with Mr. Oda a few years ago to get legal advice on a whole bunch of unrelated issues. He could not have been nicer, more professional and more helpful. He gave us great advice, and after more than an hour, he said, "Well, I guess I have to charge you something...how's $50?" We were expecting to pay at least twice that much...

As Kathy said, he has a lot going for him!

Thanks a bunch you guys. I know we are not alone going through this, but making the decision is the most difficult thing.
