rob, thanks for taking the time on behalf of your readers to glance at the documents. two points of correction: first-the demand by the finance company (TOPA) was for $86,492.28 not $7500. this is evidenced in the body of the complaint and in the declaration of the fianance officer for the finance company in paragraph 8 of his sworn declaration. second,the record is clear that fred stopped the suit against him by declaring Ch 7 bankruptcy. this is evidenced by US Bankruptcy Ct.Petition 8:94-bk-13293-JB filed on 4-1-94 (6 weeks before trial). the debtor is listed as frederick f blas of el toro ca and fred blas firestone.

in going thru the docs of the conversion suit against Fred a few other items jumped out:

1. As a defense to not paying, Fred claimed the equipment was faulty/defective even though he certified at the beginning of the lease the equipment was in good working order. Also, Fred agreed at the beginning of the lease that even if there were a problem with the equipment he would still make the lease payments.

2. Even though there was no final judgment in the case ( which was stayed by Fred's bankruptcy filing) the leasing company, which feared Fred would sell the property to a 3rd party or move it out of the jurisdiction, was able to obtain a writ of possession by
posting a bond for $7500, which entitled them to seize the equipment. They did this because they were able to convince the court that in all probability they would win at trial.

3. Unfortunately for TOPA, it appears Fred was a step ahead. When they arrived on 8-13-93 with the writ they were only able to recover 4 items. At this point Fred, with the RCI Asset Recovery on his trail, gives up on his affirmative defenses and now asks that he be allowed to pay less over more time. Its not clear what happens next but on 4-1-94, 6 weeks before trial, Fred gives up and declares Chapter 7 bankruptcy. TOPA is left holding the bag for tens of thousands of dollars of equipment.


4. another thing that stands out, that on the way down, Fred could have mitigated the damages sustained by TOPA as a result of his failure. It appears from the documents that TOPA had a buyer for the equipment. Had Fred returned it, TOPA's damages might well have been far less. Fred did not do this, but instead moved the equipment from his main place of business at 1734 N Main St to another location at 902 Main, thus thwarting the efforts of the leasing company to recover what was rightfully theirs.

5. While anyone can have bad luck in business, it appears from the record, that Fred did everything he could not to pay a legally owed obligation prior to his bankruptcy filing. What concerns me the most is not the bankruptcy, but Fred's commissions, omissions and obfuscations about his business record during this campaign. Why did he stand by and never mention his business failure? Why was he so secretive about where he lived in California, the exact location of his Firestone dealership, or even how many dealerships he had? Clearly from what has been written and from what Fred has led the voters to believe, Fred's Firestone business was the model of success. Fred's campaign rhetoric of his financial acumen as a Firestone Dealer, is in fact, the foundation of his claim that he is capable of overseeing the County's business. This we now know to be false and deceptive based on the Court record.

When you have the courage to stand behind your postings with your real name, I might have a teeny bit of respect for them . . . maybe. Yes, Mr. Tucker, here you attempt to muddy a group of names I personally respect for the very real caring they have shown, through their hard work and dedication, working for a healthier future for our island.

And yes, you started this thread, apparently as bait to discuss any past issues, troubles or malfeasance that may be discovered on any candidate, though you didn't name Blas, and probably never wanted it go that way.

Are you glad it turned into a Blas/Firestone discussion thread? Lucky you. I'm sticking to your opening topic. Pardon me, once again.

Rangster, I will credit you for standing up for your friends. Unlike Silverpenny10, Whitey and jtkong who want to launch attacks on their opponents without showing their faces. There is nothing inappropriate about defending your friends. I respect that.

I'm not an attorney, but let's not vog the facts. The creditors do get the assets of the company in a bankruptcy.

As Rob pointed out, there was a recession in the early 1990's that claimed many businesses and jobs.

Without all of the facts, how can anyone claim Fred Blas was a bad businessman ?

Lets debate whether Fred was better at business or Emily, whose previous job experience was pan handling on the streets of Pahoa.
