I cant believe what I just read in the hilo paper.They guy that ran the van off the road and kill two people on Hamakau coast on Monday was let out of jail Wednesday while they investagate the charges.Then he goes to court on Thursday for parole violation for another dui charge last year and the judge lets him out on bail.This guy has a felony road rage conviction, 5 speeding tickets and a dui conviction where he didnt do any thing that was requried of him this all was suppose to be done by August of 20011 why isnt he not in jail for this.MOnday this guy was driving with suspended lic, no insurance,tested postive for thc and oxycodone and a 7 year chid in his car. So the judge lets him back on the street what up with this.

Just a guess, but is he the judges cousin? Uncle? Brother? Something...seems like a lot of stuff is overlooked in this culture with an excuse sonewhete along the lines of..."oh he not a bad boy, he just a little confused OR oh he not a bad boy, he just met some bad people. Once again zero accountability in any political body or business I've found yet on this island.

According to Damon Tucker's blog, this is also the same guy who was involved in a road rage incident in 2007 where he punched another man in the face and caused the victim to lose his eye! What is the judge thinking to release someone with such a long and extensive track record of dangerous, selfish, irresponsible behavior that harms innocent citizens?

The biggest thing lacking in the Big Island criminal justice system is accountability. This extends to accountability for perpetrators, the police, the prosecutors, and the judges. The sequence described in this thread pretty much sums it up for the perps. In what insane world does somebody on probation not get tossed in the slammer for such a transparently clear violation that involved two deaths? On our island, that's where.
As for the cops, the Police Commission is a sham, and there is no real independent authority to investigate instances of police favoritism, refusal to follow up on complaints, or any number of other things. Judges, once appointed, are very hard to remove from the bench in Hawaii unless they get caught breaking the law red handed. Consistently handing down overly lenient sentences or allowing plea bargains that are not in the interest of justice won't get a judge removed.
The only criminal justice area where the public has a real say is in the election of the Prosecuting Attorney. We should all pay close attention to this race and prevail upon the two candidates to make accountability the central theme of a new administration in that office. I have concerns about both candidates that should perhaps best be detailed over in the Punaweb political forum. This is very important stuff, folks.

If the mother of this child let this child go in his car knowing his history, and proclivity to substance abuse, IMHO the mother should also be sited for child endangerment. Obviously the court is not stopping him, but they can attempt to stop people letting their child in a car, just like you would not put your child in a car with a known pedophile.
Some one has to say no. This child's mother or caretaker would have been a good place to start.
Who was the judge that let him out? I believe some letters to the judge and copy to the prosecutor would be a good idea.

Are you sure this is true? I just read what I think is a recent article that says he was released on this charge pending further investigation, but is still be held on a no-bail warrant. He might have been released on the one charge only temporarily as he would have to have been granted bail. In any event, I don't think he is out on the street.

I did read the hawaiitribune-herald article and it says he made $20,000 bail. Again, we have conflicting news stories. The herald has been making a lot of factual mistakes lately and slow to correct them.
