Hogwash. That's a T intersection and there would be stop signs. If there's an accident it won't be because of the road. It will be because of bad driving.

To KimoWires: sorry, I sent my response before seeing your edit.

Those signs at the end of the roads are quite limited protection. If an attorney can 'prove' the sign wasn't there at the time of the accident, hard to see because of overgrown vegetation, too dirty to be clearly legible, or even if it was raining so hard that it was difficult to read, we can be held liable. And as we know all too well, there are many people willing to bring a lawsuit if 'deep pockets' are part of the picture.

That's ridiculous. There's already intersections like that all over the subdivision. No stop signs on 4 ways leading out to Orchidland Drive where people speed by. I've had people pull out on me lots of times. One has to be on their toes yeah..paying attention. Your argument doesn't hold water. That would be a very safe intersection by comparison. And if your last sentence were true we would already be overwhelmed with lawsuits.

One interesting tidbit I learned recently: As was mentioned above, all of the Orchidland property owners would be liable for any damages occurring on our roads, since we all own a fractional share of the road TMK. But property owners who are current in their road assessments are covered by an insurance policy taken out by the association. If you're not current on your road assessments, you're not considered a member of the association, so you're on your own.

I heard that. But seriously, Does anyone know of any case where an association was successfully sued because of an auto accident? I've never heard of one.

Not worth the effort for a fender-bender, but if enough people die because there's no way to evacuate ahead of the lava flow, I'm sure the lawyers would find someone to sue.

Put another way, there's obviously no problem with "privately owned public road" liability issues, or the County would step in to annex all these roads and protect the residents thereof, right?

WTH!
Last year I spent over 20 hours of my own time repairing my road, filling holes and spreading gravel. I patched holes in the chip seal on Orchidland drive several times and even mowed our corners.
In my opinion I've done more than the association! What did the association do last year for the $165.00 they are extorting from us?

This is why I chose Hawaiian Acres. No mandatory road fees, no property liens for non-payment.
We used to pride ourselves on the state of our roads as the disrepair kept (most of) the riff raff out.
There used to be signs at the beginnings of One Rd, Eight Rd, and Eleven Rd, stating that the roads are private and you travel upon these roads at your own risk.

The worst thing to happen was the P.E.A.R.
The influx of undesirable traffic was enough to make me sell my lot on F & 7 and move to my present location in the opposite end of the subdivision - still no power on my road, and the build-out is proceeding slower here than in other areas, so I still have some solitude. My house hasn't been robbed at all in the past 14 years.

Big Island, go to a road meeting and ask. The answer may surprise you.

At least you do something to help out (as do I) while many people complain and complain and that is about it. Talk is cheap and easy.

Meetings are the second Tuesday of the month, at Blaine's. Starting at 5:30. There is one tomorrow.

That's a Road Committee meeting tomorrow. I wonder will any Board members be there?
I might like to hear what the road crew thinks about the BoD and their changing from paving Iilima, mid stream, to chip seal repair.
