So did I get out of all this that legislation somehow got passed at the county level that selects Puna as the one area where living in a tent is prohibited?
If it is now illegal is there a series of fines based on degree of tent living? Based on level of intent? Intent to live in a tent? What were your intentions when you set up this tent?

No. Legislation was passed by the council but vetoed by the mayor on the grounds that it violated equal application of law amongst the several district's. The law would have also undermined a right that already exists. There is no current law on the books that forbids tent dwelling on your own private property for your own persons. The current law only address's tents in public events, public areas and for business purposes and it's for fire related matters.

The aspect of wedding parties and other like type private events falls under a general protection of large gatherings of people but does not address individual use purposes. There are exceptions with regard to yurts and more permanent type cloth structures within the building codes but again, those are permanent cloth dwellings and must be permitted under such conditions.

Ah good! Thank you for the clarifying response. This topic is more of a mental exercise in learning what is going on. I am glad that common sense somehow prevailed.

CC&R's within your subdivision not included. If your subdivision disallows such practices, then you're bound to those legally speaking. Enforcement by your subdivision, if any, is another matter.

Forget living in a tent on your own property, if you're Hawaiian, you get to live in a tent down at the beach!
