HPP Board Meeting conflict

Anyone else at the HPP Board Meeting last week on Wednesday night?
Meeting starts with long monologue from HPP lawyer defending the GM.
A guy from the audience shouts BS a couple times and the HPP chair adjourns the meeting!!!
Is anyone on Punaweb aware of what these conflicts with the GM are about?
I was there for another matter and was surprised by all the tension and drama.
Maybe it is about the roads and the dumping of green waste on 16th nearby the HPP hui?

Tension has been building for a long time, and the green waste issue is just the most recent problem that quite a few members have lay at the feet of the GM. He apparently negotiated the terms of the contract that resulted in the dumping citation from the State. Having the association lawyer there defending him seems like an expensive and overly dramatic response to the criticism.

Adjourning the meeting without a motion to adjourn is probably a violation of the by-laws, BTW, showing both a lack of courage and lack of knowledge of Robert's rules by the board president. The meeting has been rescheduled as a "Special Meeting" for this Wednesday, the 28th with the same agenda. Lately, the office staff has been reported to be refusing members access to records that are not confidential, but I have not experienced that personally, only heard about it. HPP is a mess that never gets better.

Has the guy shouting "BS" ever run for, or served on the board? Or is he one of those folks that only show up to piss and moan?

He has never been on the board.
He was upset that the lawyer was defending the GM's actions. He apparently has had other experiences with this GM.
BTW, the GM, Scott Refilling does not live in HPP. He is the only one sitting with the board that is paid and not a volunteer and who doesn't live in HPP. The GM answers to HPP board.

so, does the benefit package for the GM include legal services being paid for by the members of HPPOA? i don't think so...my thinking is...the GM needs to pay for his OWN legal services. what happens if the BoD take legal action against the GM?...which side does the lawyer represent? gm or bod?

Are you sure he sits on the board as a voting member?

I've been on several non profit boards and the paid manager attended all the board meetings but was never a voting member. I have no issue with the GM not living in HPP; in fact not living here removes him from any suggestion of conflict of interest, no one can accuse him of taking better care of his road than other roads.

I would assume that HPP is responsible for the GM's legal expenses while he's employed by the Board and acting in good faith on their assn.'s behalf. If the Board found the need to sue the GM, one would assume that the GM would have been fired or quit first, in which case the GM would be responsible for his own legal expenses (although I suppose he could seek to recoup his legal expenses from the Board if the courts rued in his favor).

Note that I am not a lawyer, but I play one on PC.

The GM is not a voting member of the BOD, attending the BOD meetings as part of his job responsibilities. There is one more person who is "paid" and sits with the board -- the recording secretary.

Most attendees at the HPPOA BOD meetings come there to be informed about what is going on and, frequently, to address real and specific matters that require the attention of the BOD and/or GM.

There is also a minority of attendees who are quite simply functioning as a lynch mob with lots of accusation and allegations, nil knowledge of issues under discussion, and no interest in fairness or justice, while displaying a terrific sense of personal insecurity as they rant and blubber wild-eyed making personal attacks at the board members, the GM, and other HPPOA employees.

While some people do get emotional, most opponents of the current regime at HPP are not a crazed "lynch mob." Many are thoughtful individuals who have participated on committees and have major concerns about the GM and the BOD. The last meeting I attended just a few weeks ago had a number of persons who seriously and calmly pointed out some big mistakes, particularly in relation to contracts and the waste dump behind the hui. James Weatherford was not at that meeting, so I guess he missed that part.

No, I never said the GM sits on the board as a voting member. As with other boards, the GM sits WITH the board as an employed non voting member.
