Council candidate accused of voter fraud!
#11
Well, as I'm sure you know, if you go far enough in either direction you end up in the same totalitarian place. I'm sure you also realize that the National Socialist German Workers' Party began as a populist, socialist group but with strong nationalist leanings, not as a conservative right leaning party as we understand conservative/right today.
But I guess we're wandering away from Hawaii, I hope.

thanks, oink.
I do not contest your philosophy regarding fraud.
Unfortunately, no political ideology has a monopoly on it.

I seem to remember there was a big case of voter fraud back in the early 80's. Anyone remember the details?

Hi Algier Dino and oink:

"Voter fraud" is specifically defined in the Hawaii Revised Statutes, so Black's is not where you would look to determine the elements. I posted the relevant text from the HRS almost a week ago. It is in the Candidate Eligibility topic and clearly labeled.

The relevant section would to mind mind be the knowing swearing to incorrect information in the voter registration affidavit and possibly orally swearing to a clerk if such was done at the time, which I don't know.

I linked the analogous story of Ann Coulter's voter fraud story in the same post.

The 80's scandal also involved "election fraud," also defined in the HRS. Election fraud is the crime that involves trying to fix the election by securing multiple ineligible votes. Election fraud carries prison time and an automatic disqualification from elective office, so don't confuse it with voter fraud, which is committed by the person who votes in a place not entitled to vote and involves the one voter.

Voter fraud is a class C felony similar to child abduction by a non-custodial spouse and some other crimes that used to be misdemeanors. Class C felony is also defined in the HRS.

When someone cries foul and says Tiffany didn't change the outcome of an election, correct -- that would be election fraud and as said could mean prison time as was served by the offenders from UH Manoa and the candidate.

Hawaii law recognizes the lesser crime of voter fraud on its own, and it is not nothing.

Note: not intended as legal advice, not an attorney. Read the statute yourself and draw your own conclusion.

Ironic that the owner of BIC is getting such bad press just before the primary. Looks like this issue got away from her. R.J. & Sativa have established themselves on the fringe of things.... BUT Frankie Stapleton is precisely what Tiffany Hunt is not: An experienced ethical journalist. When Frankie Stapleton speaks people do listen.

This will be one interesting primary. Be sure to vote.
Assume the best and ask questions.

I can't even find it now, sorry to sound like it would be easy to find. I'd not realized how long the topics was. I'll find the link.

Sativa cites the statutes on this page that define voter fraud.

Then discussion morphs into whether the Surf Shop could be a proper residence and if she could have met the requirement, and I copied in the HRS from Elections that explains residency.

Now I remember: I had gone over the definition of Voter fraud in the statutes, but I didn't need to post that because Sativa had already covered it.

Snorkle, please do your homework before you post. There always has been a District 5. It just got redefined in the redistricting prior to the 2012 election. No, she didn't steal a vote, she just gave away a free vote that did count for who she voted for illegally in District 4 yet she lived in District 5. - That is illegal and unethical since she did it deliberately.

Driven by envy, I don't think so. Who would be envious of people who are unethical and breaks the law for their own benefit. Only another con man could even think of being envious of some other person who does it better than they do. Positive change through illegal, unethical means is hypocritical and immoral. RJ and Sativa, along with many others, just can't tolerate people who do things in unethical and illegal ways. The only difference is they are willing to step up to bat and do something about it while all others just sit on their hands and let it be. So, who is really making positive change for our area. Not those that set on their hands or people like you who appears to not know the difference between right and wrong.
