Council candidate accused of voter fraud!
#71
"Anyone know if it is true that there is no way to bargain a class C felony down, because there's no misdemeanor alternative?"

Of course you can. In this country you can bargain everything.

"Let's make a deal"

Under the American Judicial plea bargain system, created by Monty Hall, and adopted nationwide, a defendant can trade their initial charge and penalty for any number of other charges behind the curtain. So say you start the game with the "Zonk" prize of aggravated assault where you left the victim laying in the street, your attorney shouts "pick door number three" and bingo your charge is reduced to littering in the third degree. You get a $25.00 suspended fine and your record is expunged after twenty days of good behavior.
Everyone shouts "the system works - hurrah, next case!"

Don't be surprised if Tiffany ends up with a new car.

I find it hard to believe that any investigation into any form of alleged fraud would be giving "status reports" to an individual without releasing the same information to the general public.

Says that either the investigation is flawed, or the individual is baiting with untrue information.

I looked for a post with your quote of "status reports" -- can you indicate where that quote is from? Sativa's update didn't say that.

There are some questions that the public can ask officials and police and get limited information, and there are some questions they do not answer. For example, they won't divulge what a witness has said to the police.

Of course, the witness is free to tell people ... including reporters.

The police can state whether there is an active investigation.
The clerk can state whether a complaint has been sent to the police.
In this case, the voters of Hawai'i County are the victims; they can get whatever information is available to a victim if they frame it that way. Victims can get updates on stuff like what stage a case is at.

Your intimation that the investigation is flawed is a totally uninformed and uncalled for slur on the investigating officer.

When stating that the voters of Hawaii County are the victims, and can get whatever information is available to a victim from a law enforcement agency is incorrect. No matter how the "voters of Hawaii County" frame it .

Victims can not be defined as an "entity" or "corporation" or "LLC" in a criminal matter for the purpose of entitlement to the on-going investigative information. There is no victim in the sense of what we are use to hearing in other crimes such as sexual assault, robbery, burglary etc… The real question is "need to know"?

Nor can or should complainants get information of the on-going criminal investigation from a law enforcement agency.

Have you ever heard the FBI provide information of an on-going criminal investigation, for example in a "Threats of Terrorism" case, where the citizens of the United States are the so called "victims" - rare!

From reading above, the law enforcement agency, if in fact is conducting a criminal investigation may have provided information to a reporter, who in turn provided it to a complainant.

Again, typical response from you Kathy!

You really need to look into the two people you follow blindly.

Really, you do!

With over 300 plus posts demeaning TEH and now you wish to discuss my "slur?"

You truly are a warped person Kathy!

KathyH, the court basically failed in it's duty to the voters and is letting the House decide Say's fate - that is, if it wants to. Per the usual "circle the wagons" protectionist actions of the House, word is that Say will likely face no further repercussions on a legal or professional level.

The voters might do otherwise, but doubtful given the many years this residency issue has been going on and the number of Say's reelections to office.

Folks have been allowed to carpetbag here in HI since almost forever with no real risk of any meaningful action being taken.

Thank you, Anxious Messiah. I understand now what you were referencing. It does stink. I see from comments that some of the people are at least getting fed up, but it looks like your prediction is how it's going to resolve, nothing changing.

Discuss Truth quote:"You really need to look into the two people you follow blindly."

Discuss truth, for a newbie you sure do reflect Tiffany Edward Hunt's feeling towards RJ and I. Are you friends with her? You must have her confidence to talk so intimately about her activities.

Since it appears that you know Mrs. Hunt well, could you ask her why she got another person mixed up in the same voter registration scheme as she was involved in? Could you ask her why she was trying to control the politics of a district that she didn't live in and encouraged another to do the same by registering into the surf shop one day after her?

If you want a mean spirited, foul writing, foul thinking, alcohol drinking, cigarette smoker, who represents a whole bunch of old farts like bob and Julie Jacobson, who are living vicariously thru her then go ahead and elect Tiffany Edwards Hunt. What a role model.

I must have missed the part where it matters who eventually gets elected.

A toothless former crack head and her partner who adopted the name of a strain of marijuana and you wish to discuss role models?

And then resort to calling two members of society "old farts?"

I would take several hundred thousand people the likes of the Jacobson's and TEH before I would take one of you or your toothless crack head buddy that's for sure!
