My lot is not formally listed- although I am considering it. I was also considering buying an unimproved one and just letting it sit there, after my bulldozed one sells.

Frankly I don't see the point in paving Ilima street

Dare I suggest: the subdivision is too large for a "one-size-fits-all" road assessment.

Split the road improvements and let residents vote their road, possibly at a higher rate for those with direct frontage. If people on Aulii (or Ilima, or Pohaku...) want more pavement, let them vote for their road and pay for their road.

It's very difficult to change the protocol written into the bylaws. Unless it is done underhandedly. Like in the past. Some Board members favored certain areas over others.
They need to stick to the Original paving plan. When all the paving of the main roads is done then maintenance will be easier and monies can be focused on improving the condition of the side roads.
One Thing I can always be sure of is that things will never go as expected.

I am willing to pay the new fees, as long as they do the maintenance.
The road fees are less than my fees on property in HPP.
I have 2 acres in Orchidland with my residence and pay less than my vacant 1 acre lots in HPP and all of my property is on gravel roads.

FYI, the original road paving plan called for paving Ilima. Years back when a board tried to change that, using the same logic as you, the result was a lawsuit and the board was forced by the court to keep Ilima in the paving plan.

For clarity the bylaws define the MRMA fees as: Mandatory Road Maintenance Assessments
Explained in Article IV as:
Monies collected for MRMA’s shall only be used for road maintenance and road improvement projects

As such, the act of paving appears to be covered as either a maintenance or improvement project depending on the road? Are there statements that the current $85 is ONLY for maintenance & administration?

As for the $100 Paving Fund - this is also a mandatory assessment as it is approved annually during membership vote correct? How is it defined for the vote? Pavement? New Pavement? New Pavement as specified in the Paving Plan?

Any links or extra info regarding the court action enforcing the paving plan? How did it obtain the force of law and what would it take to modify it (if needed)?

Sorry for the many questions - own a lot and trying to get my head wrapped around the issues for the upcoming meeting.

Anybody consider that the sub-divisions north of the flow are, although I do not have supportive evidence to sustain this but, I noticed the other day, increased prices above the flow. And, would expect an increased population in those areas, hence, the need for critical planning for increased traffic. Most especially as Orchidland is amassed with speculative 'investment' lot owners, there's a lot of controlling interest to improve their value during a potential transition.

I am definitely against any road fees. The county should be responsible for the roads.....

Back in the early days the county wanted to use 40th as a route to install power lines. The board at that time I believe was for it, but certain members that lived on 40th shot it down thereby ruining any chance that the county will ever try to help again. the good road became road 8 in Hawaiian acres and that alternate route is kinda out of the way.
So we are on our own.
Now, even if the General membership approves a paving assessment the legal fact still remains that lot owners will still , by law, only have to pay the $85 MRMA.
I will agree to pay paving assessments if they are concise and if it appears that there are no hidden agendas. KW
