This same company has had some serious safety issues, including leaving two children (9 years old) BY THEMSELVES on the trail for more than an hour, in the dark and rain, telling them to wait for their parents to catch up. They have also had several instances of losing people out on the trail. They are the poster child of how NOT to provide for seeing a lava flow. I hope they are prosecuted to the full extent of the law. Their arrogance and disregard are astounding.

One thing I haven't noticed to since moving to Hawaii, is the distinction between civil and criminal offenses. Does this distinction exist under Hawaii State law?
Good question Tom. New laws are being written right now like Hawaii's new 111 law, look it up for its really well written.
DLNR has these extra resources to play under cover lava tresspassing operation cops. Then would it be possible to get some kapoho tidal pool cops and investigators. Maybe some environmental study to why this dramatic Ohia die-off is affecting all types of Ohia in various places.
Maybe things like over bulldozing and planting GMO papaya could effect surrounding areas. Or maybe all this extra government and commercial air traffic Puna gets now due to lava and world tourism is suppose to look like death, at the expense of home and property owners of course.
Maybe some or all the hot water geothermal sends back down with its chemical agents works its way back up to the surface through mud or steam holes and back into our atmosphere for localized acid rain to occur?.
Anyway congrats to the DLNR officers who made a difference in grabbing these two no good lying thuds who are obviously ruthless aina haters. Its a good start. Only my opinions on another frustrating day behind the imaginary lava disaster line. Can't seem to send the kids out in this bad smelling smoke or even go Mow my grass without a mask.

In order for these tour groups to access the lava, or to go up the road leading to the old True Geothermal well site, they have to drive through private property in Ka'ohe Homesteads. Without permission. Most of the residents do not have liability insurance, so if these tourists harm themselves (even/especially through sheer stupidity), the Ka'ohe landowners can lose everything if sued. Also, strangers spocking out the lay of the land, noting which homes have evacuated and might be ripe for the pickings, or blocking our narrow roads with their tour vans, is unwelcome and unacceptable. None of you seem to have realized that as a possible scenario. I live in Ka'ohe, and I am not the only one of us who is concerned about those intrusions. I would like to see those tour guides given the maximum the law allows in order to deter future trespassers.

Is the county still controlling access to Ka`ohe? Last I looked there was a guard at the entrance.

I guess that is also an important aspect of practicing their cultural rights as well. (yes, I know they're feral cattle, but $1,200?? and they leave most of the meat on the ground)

Rene I hear you and don't disagree with you about added traffic in your neighborhood. Sorry for your continued inconveniences your Ohana are currently putting up with. Your right about the added spockers and traffic on a narrow road.
Yet Hawaii's parks and beaches aren't free anymore, the government wants to double the daily volcano pass this coming year. So if a small donation or fee was taken with a small portion of the proceeds going to you and your neighbors whether you stay or go for as long as this shield of lava protects your kaohe homestead subdivision. At the same time the area would have added jobs and a brighter outlook for pahoa's businesses and or economy.
Why is that road into the old geothermal plant so well maintained with no real use?
Maybe an alternate road could be made from the top of Leilani to this geothermal site? Now would be the time with all these added resources for roads.
Probably had a few residents down in kalapana who also did not want the added traffic or spocking yet the county allowed some access.
Had many complaints about some of the rude or assaulting tour guides down in kalapana yet not to many arrested for the several years of trespassing, so why now?.

Yes, private security guard, moved from the football field back to the Cemetery Rd. intersection. Not onerous, which I'm glad for.
