HPPWatchdog...Supporting the terminated employees is not watch dog behavior. Seeking truth and speaking out for the association is what watchdogs do. Regarding your last post..seek out who the current HRC members are.
I attended my last board meeting for awhile for one reason only..to speak to the board face to face after they decommissioned the RTSC via an email, and to educate them and the newest directors of the various road safety improvements and safety policies (approved by the previous board) that the RTSC was responsible for. Most of them have not attended previous board meetings or volunteered on committees, so are unaware of the many improvements made over the past 4 years.
RTSC's responsible for the road reflectors on the main drags and many are missing now after the albizia tree clean up during post storm Iselle. Share the Road signs, 4 way stop @ bottom of Paradise to slow traffic before proceeding into the curve on L Rd, road markers on a main drag next to a deep embankment (we have many yet to be done), new red diamonds at bottom of Makuu and Ala Heiau, blind hill and stop signs where there was none before, etc.
Our signs will be installed to the whim of whomever's in charge and not to county specs. There is need for safety improvements on our sloped and/or rocky shoulders along our main drags which no GM or board since I bought in HPP has tackled. Many of us are scared to pull off our roads in an emergency. Our roads are not private because they're used publicly 24/7 so it's prudent to be proactive with road safety and liability.
Almost finished was a potential road safety policy that will never be. It would've given all future GM's a standard to follow on ensuring line of sight for the cross streets. Also in the works was proposing a policy that would ensure that encroachment removal costs wouldn't be absorbed by the association but by the owner who encroached. Our road fees are supposed to be used to maintain our roads and shoulders, not for the removal of our neighbors' encroachments. I believe we will be paying for our neighbors' encroachment removals as this is what's happening right now.
These RTSC improvements are what most would call proactive or forward thinking (their term). I asked the President to tell me why she/they considered road safety redundant and RTSC not forward thinking. I wasn't given a reply. Mahalo to "D" and the new RTSC member for your support in requesting the board reconsider decommissioning RTSC. There is fear of retaliation by certain board directors towards members who speak up for our bylaws and policies. Some of us have experienced what happens when you speak up.
The question is how do we make the board accountable when they're breaking our bylaws without going the expensive and laborious route of recall? Something perhaps can be added to the bylaws to assist with this issue? Mandatory bylaw education for their 1st 3 months on the board? Any other ideas out there?

On my Mac at least, when I click the link the minutes automagically download to whatever is your preferred download folder.
(Mine is Downloads, but some people download to the Documents folder or to the desktop). (and this works for me in Firefox, but not in Chromium)
It seems to me that whoever is managing their (not "our") website keeps adding, deleting, and changing information around. Minutes are only as good as the note-taking and the secretarial filters prior to publication.
And yes, HPP Watchdog I agree with you that being a watchdog is about trying to keep everyone honest, not just blindly following some fool(s) as they wander over a cliff.

41 pages of finger pointing, name calling, unverifiable claims and counterclaims, plus cr*ploads of accusations of criminal behavior and felonious intent, all over an organization that has exactly 1 legal mandate: maintaining the roads of a private subdivision that is less than half built out. Doesn't anyone see how ridiculous that is?
All the HPPOA board has to do is follow the bylaws and set policy for the employees to follow. This isn't rocket science, but even with a constant mix up of the people serving on the board since the last election there hasn't been a single combination of board members that can manage to do those two simple things.
Shaking my head in disbelief as I hit submit.

This behavior is not uncommon -- public or private, "fiscal accountability" is a quaint notion.

Just tried again. Same lack of results.
Green box in the upper left "Executive Information" - Next green box "Minutes and Motion Logs"
Clicking on either of the Motions Log links or even the one for the "Former Roads Committee Motions" works fine. Clicking on the briefcases brings me to the Motions Logs or Road Committee.
Clicking on the "Minutes of the HPPOA Board of Directors" does absolutely nothing.
The working links are red and underlined, while the one for the BoD minutes is black. I'm beginning to wonder if this part of the site is being "worked on".

You'd think it should be a simple rule to follow...abide by our bylaws so why is it so hard to do? This board, the previous board, committee members, etc, etc.?? It's a continuous frustrating cycle that old timers have said has been going on for 2 decades or more and to not expect different which is certainly disheartening to hear. Arrogance and personal agendas seem to enter the picture every time. Some board members are honest and try their best while serving on the board which eventually leads to them being left out of the loop and with no voice. Either they resign, or with resilience and optimism, like our treasurer, they hang in there fighting the current.
How do we make those board members that break our bylaws accountable without going the expensive and laborious route of recall? Can we add something to the bylaws to assist with this issue? With a bylaw committee appointed by the membership, now is the time to put our thinking caps on to see if there's something we can add to our bylaws. Would mandatory bylaw education for their 1st 3 months on the board help? Any other ideas out there?
There's intelligent people on this forum who want our bylaws to be followed...Is the crux of this problem that HPP is just too large to be run by volunteers w/no accountability? Could things be any better if HPP were run by a property mgmt company w/board oversight? Would we have to have 9 district reps and if it's mandatory for our bond, can we negotiate a change if we want less board members? How much would it cost us? Would we better off to outsource our road maintenance? Right now our employees get paid whether they do the work or not, or do the job over and over if they did it poorly the first or second time. There's expensive equipment/tools that go missing, equipment breakdowns and repair costs. If we outsourced would we need both a GM and Road Supervisor? Could we cut costs there and afford outsourcing?
It seems it's time to make some big changes because what's been going on isn't working. Maybe we need a business consultant to advise us on the best way to move forward. We are after all a multi million dollar business w/a board of mainly inexperienced volunteers running the show with no accountability. It may be time for professionals.

Please note a third violation of the bylaws regarding appointing of directors.
In an earlier post we have noted that district 8 was open and advertised on the website as such. Furthermore, under the list of directors Rosanne's name was removed and the word "vacant" was listed for this district. Rosanne's name has been added since then and the vacant listing removed.
According to the bylaws under vacancy, only a majority vote of directors can appoint a director even if less then a quorum. So this means that the board acted in private AGAIN!
Votes by the board can only be made at a meeting and the reappointment of Rosanne was made without a meeting. I'm not saying that they can't appoint her but the bylaws clearly state the procedure for such an action.
So lets be clear of the three violations that are pending and the problems they will cause in the future.
1. The district one directorship was open and never advertised on the website and the board appointed a new director to the district. So they had their candidate chosen already and any other owner in the Park could not apply for this opening.
2. As mentioned above district 8 director was reappointed without a vote because no meeting was held.
3. District 3 for which was just opened by Chris resigning was not advertised within 2 days and still isn’t on the website. Maybe they have chosen that candidate too.
If these items are not corrected any attendance or votes casted by these districts will be invalid.
Since I will be off island for the December meeting someone or everybody needs to call this problem to the boards attention by amending the agenda to address this issue.

The most recent post by mermaid 53 is thought provoking and an excellent contribution to the debate.
However, I disagree with one small aspect of the consideration of adherence to the Bylaws:

The Bylaws are written in simple, clear declarative sentences that a high-school student can easily understand (I've tested this). There is no need for education. And they do not need to be memorized. Using the "search" feature on a computer brings one to the relevant citation.
The fact is that the transgressions that have been made are because Directors do not follow the Bylaws if the Bylaws counter what those Directors want to achieve.

Roseanne had never resigned and the President thought she had. The President erroneously posted the seat as vacant even though she hadn't yet received a resignation letter. The mistake was straightened out by giving Roseanne her seat back.

The District 1 director hasn't resigned. Another error made by the President and seat filled without receipt of a resignation letter. The volunteer voted into the District 1 seat erroneously, had initially applied for a vacant seat some time ago and should've ethically been given that seat when the other person who was voted in had withdrawn. (The one who w/drew bc she said she had been threatened).
3. District 3 for which was just opened by Chris resigning was not advertised within 2 days and still isn’t on the website. Maybe they have chosen that candidate too.
Maybe they're waiting for a resignation letter this time??? OR that seat is going to the director the President had put into the district 1 seat erroneously. She has to fix this error somehow!
What a domino affect of **** when one doesn't follow the bylaws!
