Hawaiian Acres Issues
#1
I am a dues paying member of both the Community Association & the Road Corporation. This thread is to discuss issues and solve problems. Coming up in April is a vote on possible HACA bylaws amendments.

Proposed Bylaws Amendment #1, Article IV:Section 2

An interpretation of the proposed bylaws amendment dealing with proxies is that proxies ARE allowed on any issue where a balloted vote opportunity has NOT been provided. Therefore, I will continue to issue my proxy to a member in good standing who will be attending any future general membership meetings, each meeting individually, if this proposed bylaws amendment passes. This will enable my voice and vote on issues not on the agenda.

In addition, the proposed amendment does not consider that proxies will be received in the revision to Article IV: Section 2 where the word “proxies” has been lined out when speaking to how the proxies’ results shall be stored. Further, the proposed amendment to Article XIII, Removals & Absences specifically states the use of proxies, again highlighting the need to keep the word “proxies” in, as these are results/records that need to be kept safely in storage.

Therefore, I will be voting NO on this particular amendment, as it requests the deletion of the word “proxies” in (3) & (4). The amendment in (2) specifically allows proxies in certain conditions and the resulting paperwork must be handled and stored properly.

Further, if there is passage of the amendment, I will look for the proposed quarterly membership newsletter to include the agenda, along with the ballot, at least 6 weeks before any general membership meeting.

As a non-member of HACA, I am not entitled to vote on these issues, nor do I consider myself bound by their decisions. Is HACA empowered to speak on behalf of all landowners?

Don't you guys do an annual mail out to all property owners?

My subdivision does; and includes a ballot section for owners to vote on any by-law changes(and send in their road maintenance fee, or any donations for Park or kids programs) The cost of a postage stamp is much more affordable than air fare, and much more straight forward than proxy voting.

the new HACA board stated at the last meeting that they would work on a newsletter but did not feel they were under any time constraints to get one mailed out . nor did they feel the need to send out a letter to inform the membership that they had changed the meeting dates and times

HACA is a membership organization. It does not speak for all lotowners. However, it does own the community center and 2 other lots. If you ever use the community center, then perhaps you may want to consider joining HACA, $30.00 a year.

There have been attempts to communicate with members and all lotowners at least once a year. Some of these efforts have failed in the past few years. However, it looks like the new board will be postal-mailing out at least 4 newsletters a year, to members only. I will be encouraging them to also postal-mail at least one of those to all lotowners, as historically, keeping in touch with all lotowners has always increased HACA membership.

I also love the Acres. I wish to see HACA & HARC move forward, increase membership, and work for the community! It is only a small band of "trolls", not organized and this "band" lives on mis-information, innuendo and outright lies. Surely the truth seekers will help starve them out!

If you ever use the community center

Oh, no, I drive to Hilo for that kind of thing.
