Lava tour operator hit with another lawsuit
#11
"seeking to limit the company’s liability to $300,000"

That's ridiculous. A standard farm liability policy covers 2 million. If this guy was under-insured that is just a bad business decision.

Twist: the lava bomb was artificial, fired by local surfers sick of Shane's customers and boat hogging all the bathrooms and water spigots.

Well, fired or manifested, we're waiting on the results from the X-files.

Anyone here remember he posted a few times ?

Lots of first hand witness to his B.S. both in and egress on the ramp.

Well that's strange. His last post (as LavaOcean) was 8 months before you (as RWR) joined Punaweb.
Sure, you could've been lurking but actually you were pog and then you were airportparking and both times you were banned.
Now that's tenacity, most people won't go where they're not wanted.

"He took thousands of people there without incident except for this one time. I assume he made all his passengers sign a hefty waiver.
I think he'll be just fine.
"

I don't think waivers have much of an effect if the defendant is determined to have been negligent.

it's the mind set of people now, to sue not only for damages but for as much as the blood sucking lawyers can squeeze out of anyone and all
just look out how many ads they run on tv here in Hawaii encouraging everyone to sue sue sue

Or try even harder and get three lives.

As an OWSI, we have yearly reminders that waivers will not cover much of anything & one thing that the courts will look at is not the # of times no one was HURT, but the number of times safety regulations were not followed to the letter of the "standards of care" & law...

Every class member I have taught could be asked if I followed protocol.... if I did not with every class, I have opened myself to liability...
I am sure the same is for Lava Ocean Tours... & how much liability has been opened up will depend on the legal structure of the both the company and the operator ...
hopefully both are fully insured.... but the lawsuit filed by LOT & Turpin may mean there is not sufficient coverage, both insurance & corporate structure...
