I remember when it was suggested that tour companies fly over the ocean rather than expose residents to incessant noise by flying over their homes the tour companies claimed it was too dangerous. Too dangerous for who??? They claimed it would cost them too much money to buy the safety equipment required to fly over water. If people going on tours want to accept the risks of flying in helicopters fine - but nobody on the ground just living their lives should have to pay the price. I hope it's a wake up call.

Devil's advocate here. Nobody on the ground was killed. Nobody on the ground just living their lives DID have to pay the price (this time).
Deaths from an air crash generally are pretty horrible but they are infrequent. As a society we pretty much rationalize the slow daily grind of death that goes hand in hand with our automobile based lifestyle. Funny to obsess about one while ignoring the other, like cheerfully riding a motorcycle to the airport but clutching the armrests in fear during take-off and landing.

The same tour company had a helicopter accident in October in Kaneohe, pilot lost consciousness, passenger took control for hard landing.

They said the same thing about marijuana, can't legalize it 'cause the feds blah blah blah... and then once one state said otherwise all of a sudden the feds capitulated...
This is the United States, not some federal detention camp. States that have autonomy. Hawaii could regulate air traffic as soon as it has the will to do so.

Hawaii lacks the will to deal with many of its problems. Favorite excuse: "not our kuleana".
As to the FAA, perhaps they could write an "Air Tour Common Procedures Manual" governing air tour operators.
