Bill 108, short term rental when living on site?

Sorry if this has been previously discussed.

Reading over 108, it looks like hammer coming down on short term rentals. Parts about a fund for enforcement, and any advertising being evidence of running a short term rental. IE, they gonna have people reading VRBO and AirBnb and checking all of them for valid permits, and going after the people who don't have them.

HOWEVER, there's this part:

"Short-term vacation rental" means a dwelling unit of which the owner or operator does not reside on the building site, that has no more than five bedrooms for rent on the building site,
and is rented for a period of thirty consecutive days or less."


Does that mean you are off the hook if you live on site? You can rent a small detached house or bedrooms out without permits so long as you live/host there?

That depends how County chooses to define the terms "reside", "building", "site", and "bedroom".

I'm sure permits are still required, and it's just a matter of time before RPT comes up with new tax rates for "owner-occupied TVR".

I'm not 100% sure but I think you still have to go through the permit process and apply for TAT license and get a zoning exception. The only thing living on the rental does for you is allow you to get those two things. I think you also still need to fit the criteria of operating legally prior to the cut off date and have paid a cycle of TAT/GET on the rental already.

It's past the deadline now, so I think you're too late, but I could be wrong. If you don't have a TAT now, you're already illegal.

B&Bs are expressly allowed in the ag zone, so you shouldn't need a zoning exemption. There seems to be a lot of contradictory rules in the land use laws though.
