Rosa Parks was arrested, removed from the bus she was riding on, taken to the police station, jailed, posted bail, and was found guilty. Her attorney appealed, but before her case could be heard a similar case ruled buses could not be segregated. After her arrest black residents in her town boycotted the bus system, and walked to work, grocery stores, everywhere. They didn’t prevent buses from operating. If Mauna Kea protestors wished to follow in Mrs. Park’s footsteps they would not block the road, they would refuse to drive up Mauna Kea, and would only travel there on foot. https://www.beaconbroadside.com/broadsid...parks.html Rosa Parks is a hero to many people, I can see why your auntie looks up to her. She and others led the way for public transport to be integrated, and was a symbol for many in the civil rights movement as they broke down other barriers which denied equality for black people in America. She was willing to be branded a criminal, and walked everywhere she went for a year. Using the tactics of real civil disobedience she won her battle. She accepted the disruption and turmoil in her life caused by her convictions with grace and without complaint.

The resolution through civil disobedience would be for the protestors to be arrested, go to jail, get out, and build enough of a movement to occupy spaces on various Ceded lands (airport, Walmart, etc) and be arrested repeatedly and en masse and challenge the cases until the courts took action and forced DHHL/OH/Sate legislature to live up to the legal obligations in the State Constitution. This preserves both the Rule of Law and addresses the underlying issues all within the current framework.
Another option would be to pursue Federal Recognition and negotiate for the return of previous held lands. Again, legal solutions to legal problems. What is happening up there is not civil disobedience - it's lawlessness. Let's see how many people are inspired in the future to take the law into their own hands when they disagree with it.

It is setting a precedent of lawlessness in an already backward place that is really quite scary and concerning. Who will break what law next and will there be any enforcement? Mitch Roth need to resign if he can’t do his job.

I think Mitch Roth needs to follow chain of command, and he's not the boss here. It would be nice if he could bring in the Feds though.

He needs to prosecute to the full extent of the law and needs to impose harsher and mandatory sentencing for repeat offenders. All of the aforementioned he has had trouble with in the past.
Many of the leaders of this circus were arrested on the 16th? (Don’t quote me on that date) and they were back up the mountain the next day.

Your auntie should know that 2/3 of residents, and half of native Hawaiians, approve of the TMT, so it's not as simple as Hawaiians vs newcomers. Even many that are anti-TMT don't agree with the road being blocked. As such, the protesters are misrepresenting themselves, and don't deserve to be negotiated with. I think the most workable solution is the one already upheld by the supreme court: dismantle 3+ other telescopes as this one is being built. Separately, I do believe OHA/DHHL lands and assets should be turned directly over to Hawaiians and other families that were citizens of the kingdom, so they can use the land as they see fit. |
