What driveway?
You can't connect your property to a State or County road without getting a permit and paying a fee, work to be performed to standards by a licensed contractor with minimum $1M liability insurance, indemnity agreement, minimum 48-hour notification. traffic control, and possibly posting of a bond in the amount of "double the estimated cost of restoring or replacing the street".
Were all these conditions met prior to construction of the Access Road? Because "the rules are for everyone", right?

DHHL didn't build the access road. The state did. Also technically, Daniel K Inouye highway is on DHHL land also. I wonder if there was a land swap for that portion of road or if that's going to fall back into DHHL possession.

If we're going to pretend that DHHL owns the road, then we also have to pretend that County required permission to connect to the highway.
I'm going back to pretending I don't care, because none of this affects me anyway.

They should just demolish the road and problem solved.

"The transportation department maintains operational control over the road
despite the lack of compensation 24 years later, the state attorney general's office said.
Democratic Gov. David Ige's administration is working to ensure the land swap is completed, Aila said."

Wondering, Sincerely!!!! Does this matter to any of you? THIS did not happen. 24 years later and it is irreverent to you all?
The State is openly admitting something here. Bullies, thieves, idiots, what??? How can you step over this, defend this?

As I highlighted earlier, "The States Attorney General Margery Bronster opined that no formal agreement took place and that the DOT was not obligated to transfer $5M to the DHHL." Unlike Bronster, Kai Kehele is not an Attorney General so his opinion does not have any legal weight, not to sound "irreverent"

Simple self-preservation. If you complain too loudly, the problem is that you're complaining. Whatever it is you're complaining about has already happened, or will certainly happen, regardless of public complaint.
Unless you're Hawaiian, in which case the government will probably bend to your will.
Anyone remember the composting facility?

reni and Kaimana - people do care, but there are public roads on DHHL land all over the islands and the laws still stand. This is not a big an issue as some are making it out to be. On the other hand, just demolishing the access road brings an end to astronomy on the Big Island. I don't know if it was a tongue-in-cheek comment but that would be the result. Perhaps some would be happy with that.

If you visit the Sunday Maku’u Market you’re on DHHL property. If you exit the parking lot through the rear of the property it will connect to DHHL roads, which wind around back to Hwy 130. You can drive on those DHHL roadways anytime, not just Sunday.

Someone tell Kahele that non-beneficiaries are accessing DHHL land.

Without solving any of the underlying problems. "We won! Wait. What did we win?"
