But the amount of the fees is irrelevant if they are not applied legally. In one of Mr. Wirick's posts on FB he says "we, unlike the County, have no way to force them to pay higher fees."
At least he's smart enough to recognize that a court battle with the property owner would be futile.
Battling the county has been futile in the past, but maybe this time with the new tactics?
He needs to stop accusing the wrong parties though....

Understand, but if the fee was $100 a year and they refused, that's one thing. If the assoc. wanted $5,000+ a year, that becomes a different story.

While I think everyone should pay their fair share, it's a burden for me at 78 to pay $400 a year for two lots, but I chose OLE 18 years ago and I appreciate that we have a local option for groceries, hardware, gas etc. rather than have to always drive to Hilo/Keaau/Pahoa. And with all the crazed politics of the BOD and road people, who volunteer despite the non-stop criticism, Laniuma just got paved to 40th and they do work the roads as well as ever I've seen in my 2 decades here. So hau'oli makahiki hou; I feel blessed to live far from the increasing woes of the mainland and congested main island. The wild wild east is not perfect but it's home for the duration

Hey, in Hawaiian Acres we pay road fees twice: once to HARC, which does their best with what little they receive. Then again for suspension work!

Three times: once more to County, who says "private roads not our problem (except PEAR because it suits us)".
Four times if you include State, who can't manage to use that money to clear Mauna Kea Access Road.
Five times if you've paid for any maintenance outside of that (eg, on a Limbo road).

Again, you have to put yourself in their shoes.
Suppose you and I have a contract, agreed, signed and finalized. A year later I tell you that I am not happy with my end of the deal and you HAVE TO start paying me $100 a year, forever, except that I can change the terms and conditions, including the amount, at any time at my sole discretion. And once you pay the first one you have no recourse against anything subsequent. So I can raise the amount to, say, $5,000 next year and you are bound to it. I doubt that you would agree to it, but if you would I'm sure there are plenty of people out there who would love to do business with you.
Is this a far-fetched scenario? Consider that the fee at the time of Watamull's agreement was $65 per year. He is now expected to pay $6,000 per year. I don't know if it happened all at once or if there were increases along the way, but that's a huge increase that he didn't agree to.
Also, you may have noticed at the top of the commercial fee schedule at the link I posted it says: "Currently under review by the Board of Directors". I'll leave it to you to speculate on what that means.
I'm not on anyone's side here. I just want people to be fully informed before jumping on the "close the road" bandwagon.

So ... more like a tax increase? Did we all sign open-ended contracts for higher property tax, gas tax, etc, whenever the Government decides they're not happy with the revenue on their end of the deal?

Most (if not all) of these private roads don't meet "minimum dedicable standard" and therefore can never be made public -- unless all the landowners get together and give up some of their frontage.
That's assuming anyone gets past the automatic "there's no money (for roads in Puna)".
