Liberate Third Bay!

.    The surf break just off the Pohoiki Boat Ramp, where boogey-boarders once boldly exercised their assumed right-of-way over fishing boats, was known as First Bay.  Two hundred yards south was Second Bay, which was usually surfable and occasionally had really good waves.  Around the point is Third Bay, where an uncharted offshore geological feature causes long-period south swells to more than double in size, peaking up like Waimea behemoths.

     The great news is that not only has the debris from the recent volcanic eruption migrated away from the Third Bay take-off spot, there's now actually a luxurious black sand beach smothering the vicious, two-tiered cliff that destroyed uncountable surfboards when leashes were snapped by these monsters.  And instead of paddling all the way over from the boat ramp, like we used to, you can now wade in from right in front of the break.  Or you can if you are one of those properly entrusted to malama the aina as defined by the kanaka maoli who have seized control of this idyllic cove purchased with County Public Access, Open Space & Natural Resource preservation funds in 2015.  Those of us who don't understand the manao of the mana dispensed by the chosen kupuna nui are kapu.

     And who are the thugs who -- in violation of H.R.S. Chapter 115-9(b)(6) -- enforce this illegal denial of the public's right to lateral transit of the shoreline (H.R.S. Chapter 115-4)?  Our County Water Safety Officers.

     And thus Mayor Mitch continues his relentless campaign to shut down all ocean access in East Hawaii.

Since, as another prominent poster on here often says, the county is "complaint driven", could you bring this to the attention of the county officials charged with enforcement of HRS 708-815?

To be clear: I have been told this -- in person, no less -- by various County officials; they decry the "lack of funding" and "shortage of staff" despite the fact that the budget increases every year with most of that money dedicated to salaries and benefits for County employees.

Meanwhile, they're able to tax my unpermitted house based on aerial photos and an expensive software package -- meaning they can be proactive when it suits them, if there's money to be made for the County. They certainly won't be wasting their precious time generating revenue for the State.

Broken by design, this place is.

So... What happens if you ignore the water safety officers? Do they call real officers?

It would be interesting if someone (or several someones all at once) were brave enough to call the bullies' bluff and say, "OK, let's call the cops." The result would be interesting to say the least. The thugs and/or "water safety" personnel might well back down. If not, I'd be surprised if the police arrested someone for legally being on a public beach. If an arrest were made, I imagine the charges would be quickly dropped, given the likelihood that a judge and/or prosecutor would want nothing to do with such a case. But like I said to start out, some bravery would be required for someone to be prepared to deal with all that, and in the end, that's what the bullies are counting on.

And just for the record, does anyone know exactly who put that sign up? It does not look at all like regulation county or state type, and as such should have no legal basis.

Problem is, to access the easy walk in spot, you are crossing a parcel of land that is owned by a Hawaiian family and it is landlocked and surrounded by the county owned land.
