Hi Jeff,

If you do intend on pursuing courses in some sort of civil or other pursuit, I would keep some type of daily log of what events have happened so you can have a catalog of events available for reference, along with photos, people that you have had discussions with, and others that can back you up for any testimonials..

I can give you my real estate lawyers contact as a reference if you would like, and his retainer is around 3K, but i'm not sure if this would be something he can do, but at least you can have a free conversation with him initially to see what he can offer as an option/recourse to your situation.

From my experience in such matters, which is more than I care to get into, it is a difficult type of case to make, as it's mostly the "he said" type stuff. Without proof, who can the police believe? Just make sure in your dealings with the police that you are always the calm reasonable one and never fabricate or exaggerate your story when relaying to the police. Also, when talking to the police be friendly, casual, smile and try to show a little humor. Respond to aggravation and frustration by the police with good natured pleasantries and humor. Remember they get this crap (not crap to the victim) constantly. Do have a good video camera. Had your wife remained away from your last confrontation and just recorded, it would have helped a lot. Videos don't always accurately reflect the truth but most people think they do. When you start putting supplies or equipment on the site you should consider a couple of the game (as in hunting) cameras you can now get at a reasonable price. They can be concealed (depending on location) and record when triggered by motion. Neither the State or Feds will be interested in this type of incident.

I was refering to Nagasaki's Market. It was near Nagasaki's but closer to Front. Not too far from McDonalds, which was there. I don't remember where Foodland was. It was a small sandwich shop with outdoor seating only, and not much of that. I think seating was under a banyan tree. As I recall we would walk accross a field and then West of the sugar mill and then accross the RR tracks to get there from where I was living at Fred Kobatakis Rooms and Apts.

Jeff, you can always devert the attention from the one neighbor...the one with a wife. Find out their mailing address, and his name. Then go online and order some magazines for him C.O.D. You know the kine magazines,right? I'm talking "Chicks with D..,I mean "Chicks with kickstands"! This will turn the wife's anger towards her husband. She'll forget all about you folks. It should keep the husband back peddling for a few weeks, and out of your hair too.

beachboy, ha, ha, at times i wish these types of things were within me, but alas,, it's funny just the same.

And would not be long enough, seems there's much more troubles to consider;

If i have a TRO placed on them, this fellows job will be in serious jeopardy. he's a security guard for one of the armored truck companies, Lumis? something like that. And due to his past mentioning of guns, weapons, once or twice subtle threats of their usage? i must inform the judge of these things, and with a TRO and while in full force, he will be ordered to turn in any and all guns and ammo, and further become disallowed to have any weapons under his control for the duration of the order, whether 15 days, initial TRO, 1 year, or full extension of three years..

You want to talk about an irate person, if the TRO is ordered, which we feel we should, without a job?? Well, you might be able to imagine this possible scenario..

Currently trying to write this story, and ask the judge, to allow him to continue to work, although continue this order of gun control at all times before and after... work at home etc, all except presently employed, proper, leave weapons at work.. etc.. Toughie, thing to do, so says the court clerk.. no guarantees. this is not a special condition, that's so easy for the petitioner, Me and mayumi, to ask for, very unusual, highly, and the state demands this full order.

Really, really need to consult an attorney or somtin..

They have caused us considerable irreparable damages, if we give up thousands, a hundred thousand at least, plus suffering of lost time, anxiety, hardship, harassment etc.. the list goes on, .. The district court could award us up to and not more than $20,000 in damages, but with that we would have to sell the lot and find another, this amount would not come close to the losses, not monetary, nor the complication..

We are seriously worried about their threats, but..

But do not want to jeopardize his or our entire career.

Jeff, your neighbor created the entire sequence of events leading up to this. If the potential consequences of his actions are draconian by some estimation, it is not your problem. Your investment in money, time, and now stress involving this property justifies doing whatever is necessary to legally protect yourself and your wife from harrassment and intimidation. Only you can decide if all the legal trouble and his potential reaction is worth it, but if you walk away the bully has won. He and some of the casual neighborhood observers will come away feeling like this sort of approach is what works to get what you want. Unfortunately, you are correct to worry about how he will react if he loses his job. The only consolation I can offer is the fact that many bullies are not especially brave and back down when confronted with strong authority. I wish there were a simple and safe answer for you. What a can of worms. With no easy solution. Here are couple things you might want to consider. I know, they are totally unaloha-like and reek of paranoia. But from all that you have said about these neighbors, they are not wrapped too tight:

1. Buy a recorder for your phone to have a record of any harassing calls you might get. There are special recorders just for that purpose. You can find them on Ebay if you can't get one here.

Here is a link to a site with an explanation of different state laws about telephone recording. You should check with a lawyer here to make sure it is OK and how admissible a tape would be if needed. It appears that Hawaii is a "1 party notification state":

2. I would probably have a voice activated recorder within easy reach when I was outside.

3. You can get some pretty decent exterior camera/recorder setups to monitor your property. There are lot of choices. The main choices are wired or wireless and PC recorded or DVD recorded. 4 camera? 8 camera? 16 camera? Ebay again has many listings.

If I were to do it, for the sake of simplicity, I would probably go with wired cameras into a DVD recorder/burner. But it really isn't a simple choice and depends on so many factors. Somewhat like buying a computer and figuring out how to configure it.

Just remember that wireless cameras sound great, but it probably means that the cameras will still need to be plugged into an outlet. Limits their value in my opinion.

Wired cameras have one cable that serves both power and the video image. The wired can be carefully installed.

Alternatively, you could just toss this out to different security installers here and let them worry about the whole thing.

I feel for you. You could have this happening in Oregon, Main, Arkansas - name the state of your choice. But when it happens here in "Paradise", it comes as a bit of a bigger shock I think.

my sympathies!

Jeff, they do cite for terroristic threatening, in fact I had a NFH who threatened my son in front of his wife and she called the police ... BUT the only reason they cited the guy is because their was an impartial witness. Actually a witness who worked FOR the other guy who supported my son's story. Up until that point, the stories of five people on the scene were balanced out as He Said, She Said.

I'm sorry but an unwitnessed incident will not amount to anything.

As for damages, it is very very difficult to collect for emotional distress without supporting medical treatment of physical ailments ... and if you claim it, their attorney will have the right to all your medical records and will try to paint a picture with them.

Neighbor harassment is a claim that both parties flip on the other, even though you didn't harass them, they would counter-sue that you did and the "facts" are not weighed until later, after tons of money spent, you have your day in court ... which they will pressure you to settle out anyway.

this is not a good scenario.
Personally, I would move.
I have left places that I loved because I realized the neighbors from hell would never let me be even moderately happy there.

Just wait until you build in front of their patio ... clearly your right to do so has not sunk into their brains and never will.

Don't let this eat your life by taking it on!
