why don't you still put up the fence so at least you have a buffer and while the plants are growing on your side, if anything happens to those during their growing season, you have just cause to take them to court if they all suddenly die from poisoning since you have a fence set up and your neighbors will be going way out of their way to kill your plants...eventually they will grow taller.

bamboo is a faster growing plant than what your currently growing as long as you can keep them from running or you can get the clumping variety....bamboo runners usually can grow faster, but i would use thick plastic to prevent running plants.

wow....what tactics can you do on your end to make them move out!

In a mobbing situation, the ringleader incites supporters, cohorts, copycats and unenlightened, inexperienced, immature or emotionally needy individuals with poor values to engage in adversarial interaction with the selected target. The ringleader, or chief bully, gains gratification from encouraging others to engage in adversarial interaction with the target. Many people use the word "mobbing" to describe this pack attack by many on one individual. Once mobbing is underway the chief bully foments the mobbing into mutually assured destruction, from which the chief bully gains intense gratification - this is a feature of people with psychopathic personality.

One aspect of psychopathic bullies is that they home in on Wannabe types - non-psychopathic lesser bullies - and then empower these individuals to gain the positions of power and authority they crave. Once installed, the Wannabe's lack of competence makes them dependent on the chief psychopath, which means they become unwitting but willing compliant puppets. They also make perfect corporate clones and drones. A characteristic of the Wannabe is that as well as lacking all the competencies necessary for their position, they also lack the intellect to understand the nature and manner of their compliant subservience.

Throughout the mobbing experience, the target is deceived into fighting, blaming and trying to hold accountable the minor bullies of the mobbing group rather than the chief bully. The main reason a psychopathic chief bully gets away with his (or her) behaviour repeatedly is that no-one wants to believe that s/he could be the monster s/he is. This is also the reason that many pedophiles and wife-batterers evade accountability and sanction for years, often decades. They appear so charming and plausible to naive, unenlightened and inexperienced people - usually those who haven't experienced bullying themselves. Psychopathic chief bullies are very likely to have everyone in human resources and management in their pocket, who are then manipulated into further mobbing, victimising and persecuting the target.

The golden rule when tackling a mobbing situation is, I believe, to identify and focus exclusively on the chief bully, and concentrate on holding this ringleader accountable. Expect an immediate increase in mobbing activities, and a rapidly-expanding web of deceit to be concocted against you. Alternatively, the best solution may be to make a positive decision to leave and refuse to allow these people to continue to ruin your career, your health and your life. In the unlikely event that the psychopathic chief leader is exposed and then leaves, the dysfunction, aggression and negative feelings fostered by him or her are likely to linger for years.

We planted a small, young, non invasive bamboo Noel, they posioned it...

Jeff, while reading thru some of this it occurs to me that perhaps previous owners of this lot have received the same treatment, and finally sold, therefore giving the neighbors what they want exclusivity!

If this is so it is evidence of a pattern. Wouldn't cost much to find out. Good luck.

I once as a single woman had neighbors from hell. A friend bought this property from me and he has no problems with the neighbors! LOL. Go figure, but he is big and scarry ugly, and told them point blank that he wouldn't stand for their shinagins so don't even try it. He also has a hugs bull dozer and cut a big trench thru a corner of his property to cut off their driving access accross the front of the property.

Thank you Melli, and yes the lady who owned it prior to the person we bought it from, had been approached by this south neighbor. She owned it for 15 years. All the time this NFH had been growing their little privet garden in a 20 foot area of the lot.

Except the first approach after living there for several years was a threat. There was a avocado tree in the center of the lot, She was told in such a manner; that it was threatening their house and needed to be removed, in a worried state she paid $600 just to cut it down, without removing it. After the person cut it down, he assured her that, that tree was no threat, and never would have been..

When we graded, I dug a puka, the person we bought it Fromm's dozer driver, grubbed the lot and it was berried about 4 feet under.

She did offer them the lot, however they persisted it was only worth $4,000.00 while she only wanted 8k in a 50k market.. in 2004-5.

The next fellow bought it Jan/Feb 2005 and was approached quite a few times he tells me, after he bought it for 15k within this same time period. She gladly took the 15k.. However, this next fellow put it back in the market for 79k.. The NFH approached him several times knocking at his door and I understand he refused their attempts to low-ball him.

We came along in Dec 2005..

We are having a very difficult time believing the jeopardy we are in and expect many will find this difficult to believe too. However after a year and a half, it's clear now their intentions are to literally try and steal our property, or in the least run us off.

And as they have stated, both sides, both neighbors; the north on July 16, last week, and south April 15 2005.: "YOU WILL NOT LIVE HERE!!!"

Currently we have two separate investigations on going with the police department. With luck they will help resolve this, luck..

I know you have to think of your family's safety, and it's easy for those of us in our safe, comfortable homes to tell you to fight them, but these people need to get acquainted with CONSEQUENCES. Kharma takes too long and often needs a push.

Go on and get the restraining order and let neighbor #1 get fired from his gun-toting job. (It sounds like he doesn't need to be around guns anyway.) If things escalate from that point, or you are just tired of it all, then sell and move on. If you bail out now, they have won with absolutely no consequences and probably a lot of enjoyment. Life needs to be unpleasant for these guys for a while. They may or may not be better for it, but they will learn something for sure.

me again, urging you to give up on the whole "criminal" line of thinking with them, the TRO's, etc.. It is not a police job to investigate land boundaries.

If you want to stay there, then I really think you need to go civil law. Get a good lawyer, work up all the causes of action you can support, and hit them in the pocketbook.

Do not engage with them personally again except in the presence of a third party who would be a credible witness.
All communications should be in writing and should be entirely civil and rational on your part.

Put up a camera system and let them know it's there and will pick up their intentionally poisoning your plants.

If you sue them, the chances are that their homeowners' insurance will defend them for causes of action that are not intentional; I believe trespass is one of the covered torts as is negligence. Your choice of strategy to bring in insurers, as that will put some money on the table and a possible settlement.

Also, once their homeowners' has to provide legal counsel to defend them, their own attorneys will sit on them to stay in line.

Unfair as it is, this is really a civil matter unless someone gets hurt, and you don't want that to happen.

It costs a lot of money to defend a lawsuit; has your bully experienced that yet? You can find out if she's been a party to litigation ... it's public record.

All this talk of walls and screens would be fine if these neighbors were merely intrusive or unpleasant, but they have major boundary issues, psychic and literal, and I think you should stop pushing at them until you get your rights established by bringing in an attorney.

You should stop pushing them because they might do something violent. And, I will say it again, STOP talking to them in person unless you can get an attorney to come over. He said she said encounters can so easily be flipped into you harassing them. You don't want to end up being sued for harassment and assault, but if they get an attorney that could very well happen. All they have to do is make it up.

I drove by yesterday and noticed that the guy to the north has not only built a wall (From your rocks) but is also filling in behind it with cinders. That would make it a retaining wall and it looks to be over 3’ in height. Someone help me here, what is the maximum height a retaining wall can be without a permit? Do you think he’s in violation? I wouldn’t take any action and let him finish then approach him about the permit. Or, at least let him know that you know he’s in violation and that you could turn him in at any time.


If you think health care is expensive now, wait until you see what it cost when it’s free...now here come the taxes.....

Ah, a nice four day stay in Oahu to break the pulse. Beautiful sandy beaches, plenty swimming, evening walks, almost makes yaw want to up and pay rent somewhere over the rainbow, till yaw drop. However, city life hustle and bustle is motivation enough to remember why we come to the big island. Neighbors from hell outstanding, people here including those outside of this web group, are much more friendlier, and casual..

Kathy, yeah, IF we could find an attorney who'd step in here.. To date all we've found is Lawyers who are more in mind to cash in on us win or loose.. Again if anybody knows a good, decent attorney, please e-mail us. In the mean time, it's police action and filing charges against them at every offense, and no more mister nice guy..

Thanks Scott, after throughly checking the counties guidelines or codes when they first started stealing my rocks and undermining the foundation of "our" boundary. You can build a foundation wall without a permit, under six feet.. The county web pages says; five, but it was amended to six, which has not been updated in their web site yet.
