kiko, you have the right idea it's easyist just to avoid the places with them. thats one of the things i looked for when i bought.

So someone breaks the CCRS....after sending them a nice letter and there is no response or a negative one...would you be willing to go to small claims court over it?

The Small Claims Court does not have jurisdiction over CC&Rs disputes. The District Court recently ruled against an owner for violating the CC&Rs in one of the "exclusive" subdivisions in Kona. The owner refused to pay and the association promptly put a lien on the property.

I would like a copy of CCR's for HSRE and Seaview.... Anyone have a copy for me OR where can I find them?

Actually It is HSCA, not HSRE. And one can find the CC& R's on the website www.hawaiianshores.org

Your best bet would be to contact the home owner associations. You can get it from escrow companies too, bet they usually charge for those.

(iii) Required Maintenance on Lots. (a) If any lot is maintained so as to become a nuisance, fire or a safety hazard for any reason, the Association shall have the RIGHT TO ENTER said lot, correct the condition and recover the cost of such action through imposition of a special individual assessment against the offending party;
