Damn Rob, sorry to hear about the intent to sue, that sux, like I said their are to many sue happy people out their.
I would have to agree that the individuals making the statements should be held liable if the claims are untrue, not PUNAWEB,
how many t.v channels and radio channels cover their Ass by saying that the opinions and ideas expressed, are solely of the individual and in know way reflect the opinions of whatever channel it might be from. especially those pesci infommercials.

And Again I say now you have to start forking out money to defend yourself. frivilis or not , it doesnt cost much to file suit against someone but sure costs a hell of alot more to defend yourself then it costs for the person filing the suit.

Well, saying they will sue and suing are two different things. We will just have to see.

Rob; I would consider sending the individual in question the appropriate court finding and point out that if PW is required to defend itself against a frivolous suit that PW would also file suit to recover all costs associate with defending itself. Should make them think seriously about proceeding.

As much as I LOVE punaweb, I dont think I would have the patience, to have to deal with the crap that goes with it.
Kudos and much praise to Rob for taking on such a task, I hope you enjoy being the moderator.

Punaweb has proven to be such a valuable resource, and shows what a sence of community the puna area has, dont get me wrong I know all in puna are not like those on punaweb, but let me assure you their is enough people on punaweb that it truly is a community,

Their are those that I cant wait to meet when we move this fall. And their are alot of you that I already feel like I could call on for help, and I am not even their yet.

Keep up the good work Rob. I am sure praise doesnt come around often enough.[8D]

You don't need to worry if the threathening person is unlicensed. I was an expert witness in a case like that, an unlicensed person sued for money he didn't get after finishing the job and the judge trew out the case on the spot.

There had to be another factor involved. An unlicensed contractor is just that a contractor that does not hold a license, but not necessarily operating illegally. A person is allowed to perform "contracting" under certain conditions without a license under the law, and they are legal. So maybe it was for a defective contract, outside the scope of the exemption, or the aggregated total exceeded the exemption. Just because they are unlicensed is no singular grounds to throw out a case absent any of the other factors.

Bob, I certainly don't want to argue with you, but the Judge threw out the case without even hearing arguments. He said unlicensed people can not sue for anything when the job performed requires a license. I actually was pissed off for wasting my whole day driving up to Hawi for this court case.
