Leash Law Hawaii? Come on!

Drive through Nanawale any time of day. You will have to STOP or DRIVE AROUND loose dogs. Some even chase the vehicle. I see police drive through the subdivision multiple times per day - and they encounter the dogs as well with NO ACTION TAKEN.

There are currently 3 dogs that routinely poop in our yard. I even lost a reef shoe last week to one of them. The neighbors that own them say "they have no problem" with the dogs. Of course not; they poop in our yard, not theirs.

Mahalo for all your responses and similar experiences and encounters with dogs.

In response to some of the questions:

Q.Just curious, why are you citing the Honolulu law and not our own county?

A.I could not find one for the Big Island, but was told that this is state wide.

Q.Perhaps you could have asked for a manager or the pharmacist to ask the man to leave the store with his (non-seeing-eye) dog.

A.The clerks and pharmacist were doing their best with out taking sides nor pissing anybody off, they kept calling the man to the side, and telling him to be quiet.

Q.Why was your son in the dog's yard?

A.My son was at his uncles yard and had been there many times. His cousin had lifted him up to give hugs goodbye and the dog attacked my sons leg.


I agree totally with all the complaints and experience the same of dogs running in pacts in the subdivision, chasing cars and you can not walk down a street without being aware that a dog may come out and challenge you.

Probably the Honolulu code was used cause it was easier to find & understand. The following is from the county website. be aware that HIHS has recommended updating & amending the leash laws for a few years.

You may register your dog at the Hawaii Humane Society located in Keaau telephone number (808) 966-5458, Kamuela (808) 885-4558, or Kona Humane Society (808) 329-1175.
All dogs that are 4 months of age or older must be licensed. Dogs are issued a biennial license.
The owner of a dog must be 18 years of age or older.
To register a dog you will be required to provide the owner's name, address, microchip number, home and business phone numbers. You also need to provide the dog's name, breed, age, sex, and a veterinary certificate if the dog is spayed or neutered. Also provide the dog's microchip number if available. If you have an "Assistance Dog" (Guide, Service, Signal or Hearing), appropriate documentation shall be submitted with the application.
The license fee for a dog that is spayed or neutered is $2.10. The license fee of a dog that does not have a veterinary certificate certifying that the dog is spayed or neutered is $6.10. The fees are not refundable and are not prorated.
Please contact any Humane Society for the following:#8232;Replacement of certificates of registration. #8232;Replacement of lost or stolen dog tags. #8232;To report a lost or stray dog, contact the closest Humane Society

This is an excepted portion:
Section 4-23. Female dogs.
(a) Any female dog in season is not permitted to run at large or be off the premises of the owner or keeper
during this period except when being exercised on a leash by a responsible adult.
(b) At all other times, when any dog is in season such dog shall be confined within a building or enclosure in
such manner that she will not come in contact (except for intentional breeding purposes) with a male dog.
© A penalty of $10 shall be imposed upon the owner or keeper of a dog for each violation of this section.

Section 4-24. Noisy dogs.
(a) No person shall keep any dog which barks, bays, cries, howls or makes any other noise continuously or

for a period of twenty minutes within a thirty-minute period of time to the disturbance of any person at
any time of day or night and regardless of whether the dog is physically situated in or upon private
property.
(b) A dog shall not be deemed a noisy dog for purposes of this section if, at the time the dog is barking or
making any other noise, a person is trespassing or threatening to trespass upon private property in or upon
which the dog is situated or for any other legitimate cause which teased or provoked the dog. Such action
is declared to be a public nuisance and detrimental to the public health and welfare.

Section 4-25. Noisy dog; procedure for abatement of nuisance.
(a) Any person disturbed by a noisy dog shall make all reasonable attempts to advise the owner or custodian
who keeps such dog of this fact. If the person disturbed by a noisy dog is unable to notify the owner or
custodian of the noisy dog or, after notifying the owner or keeper, the nuisance is not abated, the person
may then notify the police department.
(b) The police department shall advise the owner or custodian of the complaint and of the provisions of this
chapter prohibiting such violation. It shall be a violation if the owner or custodian fails to abate the
nuisance within one hour after being advised by the police department.
© There shall be a penalty of $25 for the first violation of this section. The second violation has a penalty of
$75, the third $100, and any subsequent violation $200.

Section 4-29. Leash required for public places.
No person shall bring or permit any dog in any County park, public school ground, or airport unless it is
held under control by a suitable leash, not more than six feet long; provided, however, that dogs even under
control by a suitable leash shall not be allowed in any County beach park. These restrictions shall not apply to
dogs utilized by police for patrol or other police purposes.

Section 4-30. Penalty for permitting a dog to stray.
In addition to other penalties listed in this chapter, the owner of any dog which strays upon any public

(1) $25.
(b) For any offense which occurs within a five-year period of a prior conviction under this section:
(1) $50.
© For any offense which occurs within five years of two prior convictions under this section:

(d) For any offense which occurs within five years of three or more prior convictions under this section:

(A) A fine of up to $500.
(B) Up to one hundred hours of community service.

ETA: Oh Devany, man are you correct on Chicago... more important was that fact that you could lose your car for animal violations (where else but Chicago?)

PLUS only Chicago has the "Lincoln Park Towing Co," aka the "Lincoln Park Pirates". Anyone who gets towed from them has a new respect for reading any & every sign....and obeying the law!

My 15 year old has had to stop jogging through the subdivision after only a few attempts due to the dogs that would take chase. If my knee would allow it, I would jog with him and then there would be some dogs with a fear of humans. I love dogs but would never stand for a dog that runs wild, chases people, etc.

All those laws don't do much good around here. There's no way I'd ever go for a walk on any street in Puna and no way I'd let my kids and dogs go for a walk on them either. Between the loose dogs and speeding cars you may not make it back home.

This is hawaii. Why would or should anyone follow or be required to follow the law as stated when there apparently no consequences for not doing so. The way the laws are enforced in Hawaii you would think that this is a third world country. As if you didnt already know in Hawaii "IT'S NOT WHAT YOU KNOW BUT WHO YOU KNOW"

So, with the exception of parks and such and female dogs in season, Hawaii County has no leash law, is that correct?

Bob, that is how I read the County Code. It is also note worthy that HIHS has been requesting better animal ordinances. The link for the 2001 assessment:

Registration of Dogs is required in this county.

There is one more article in Chapter 4 of the County Code that would have had some bearing on the original post of this thread, as the Keaau Longs pharmacy most likely would apply:

"Section 4-18. Places prohibited to animals, including dogs and cats.
(a) Except as otherwise provided, it shall be unlawful for any person to take or permit any dog, cat, or other
domestic animal, whether loose or on a leash or in restraint on or about any County beach park or any
establishment or place of business where food or food products are sold or displayed, including but not
limited to restaurants, grocery stores, meat markets, fruit or vegetable stores.
(b) This section shall not apply to “Seeing Eye” dogs or other dogs necessarily utilized for the benefit of
handicapped persons or to dogs used for purposes of law enforcement by law enforcement agencies of the
Federal, State or County governments.
© There shall be a penalty of not more than $50 for each violation of this section.

To the question....
"Isn't there a leash law in the state".
.... the answer is NO except as mentioned.
That means discussion over people disobeying the law by having their dogs walking off leash with them, or government this or that over not enforcing the leash law, is mute as there is no law that was violated.

The store may be in violation of regulations for allowing an animal in the establishment.
